Presentamos aquí un video enviado desde el Reino Unido por José Gabriel Palma, profesor en la Universidad de Cambridge y la Universidad de Santiago y dirigido a las y les convencionales, y también a quienes hemos sostenido la lucha por #NOALTPP11 junto a los movimientos sociales.
Ello ocurre porque justamente en estos días la Comisión de Medio Ambiente y Modelo Económico de la Convención Constitucional, prepara el informe general que deberá presentar al Pleno sobre Modelo Económico, en el que se incluyen las normas aprobadas sobre Tratados de Libre Comercio e Inversión. El tema de Modelo Económico se abordará como parte de un complejo informe que incluye temas como Bienes Comunes Naturales, Soberanía Alimentaria, Estatuto del Agua, Glaciares y Criosfera, y Estatuto de la Minería, entre otros.
Estimamos que los artículos referidos a los Tratados de Libre Comercio deberían recoger acuerdos que incorporen artículos aprobados en dos normas diferentes sometidas a esa Comisión por los convencionales Elsa Labraña y Mauricio Daza. La iniciativa constituyente presentada por Elsa Labraña (independiente, miembro de la Coordinadora Plurinacional) y 16 convencionales, llamada Gestión de los Bienes Comunes Naturales en los Tratados de Libre Comercio fue aprobada el 1° de febrero, y defendida por Chile Mejor sin TLC puesto que se trataba de un contenido de esta organización. La iniciativa del convencional Mauricio Daza (Independientes por una Nueva Convención, INC, ex Independientes No Neutrales) y otros, fue aprobada el 19 de marzo en la citada comisión. En cambio, la Iniciativa Popular Constituyente presentada el mismo día por Chile Mejor sin TLC, (“Aseguremos la Soberanía de los Pueblos en los Tratados de Libre Comercio”) que incluía exactamente el mismo articulado aprobado en la norma de Elsa Labraña, fue rechazada por la mayoría de la comisión.
Ante esta situación, Chile Mejor sin TLC reformuló su iniciativa manteniendo puntos centrales e incorporando el artículo único de la norma de Daza. José Gabriel Palma respalda explícitamente ese nuevo articulado que llevar adelante artículos que permitan lograr #NoALTPP 11 y tratados similares tales como el TLC con la Unión Europea. La reformulación incluye artículos sobre Plebiscito Ratificatorio, inconstitucionalidad de cláusulas que restrinjan la soberanía y capacidad regulatoria y normativa; tribunales permanentes en lugar de jueces adhoc y creación de una comisión revisora integral de los tratados post Convención, para que el Ejecutivo adopte decisiones respecto de su renegociación. A continuación presentamos los aportes de José Gabriel Palma para esta discusión, en un video dividido en cuatro segmentos donde aborda diversos aspectos.
El arbitraje y el contenido de los Tratados son dos temas fundamentales a encarar en la nueva constitución.
Mi nombre es JG Palma, soy profesor de la U de Cambridge y de la U de Santiago. Quería conversar un par de cosas respecto al tema de los tratados comerciales y la nueva constitución. El punto central que quiero hacer es que en estos tratados, de todos los temas que tienen, hay dos que son fundamentales, uno como todo el mundo sabe, es lo del arbitraje, y el otro es el de las cláusulas, el contenido de los tratados.
El problema que veo es que se ha avanzado en un área que es mejorar la cosa del arbitraje pero se está descuidando absolutamente la otra área, la de las cláusulas y si uno deja cosas inciertas en las cláusulas, uno deja abierta la puerta en esas cláusulas para que nos lleven a tribunales, está el problema que por serios, profesional y formal que sean esos tribunales, en ningún país que se tenga respeto a sí mismo, puede dejarse abierto a que las decisiones de esos tribunales vayan en contra de nuestros intereses, de nuestra soberanía y de nuestra democracia. Y por lo tanto para firmar un tratado, es tan importante ver los temas como la institucionalidad de los arbitrajes como son los contenidos del tratado.
Análisis de la norma del convencional Mauricio Daza
En ese sentido por ejemplo, la ICC 820-5 de Mauricio Daza avanza en un área pero deja la otra área totalmente descubierta. Avanza en el área de arbitraje, parcialmente, dice que es inconstitucional la corte adhoc como la que quería poner el TPP, pero pasa a aceptar cortes internacionales con tal que sean cortes permanentes con jueces profesionales. El problema de eso es serio. Estamos pasando de una situación en la cual las multinacionales nombran los abogados para dirimir los conflictos, a una situación en que los países de donde vienen esas transnacionales son los que nombran los jueces para dirimir el conflicto. Es un avance fantástico y yo soy el primero en reconocerlo. Pero tampoco hay que autoconvencerse que eso es suficiente.
Eso es un avance y ojalá que se avance más y se llegue a que sean las cortes chilenas las que decidan. Pero en aras del consenso y de la flexibilidad, a lo mejor hay que mejorar eso. Pero lo que no puede ser posible es que se ignore la otra área, la de las cláusulas. Por ejemplo, si sólo se avanza en el arbitraje, como quiere la Ministra de Nueva Zelanda, puede perfectamente seguir con todo el TPP11, tal como está ahora, y cambiar el arbitraje; pasar del área de las cortes ad hoc a cortes internacionales donde cada uno de los países miembros nombra a los jueces para dirimir los conflictos. Pero el tema del contenido sigue igual. Si sólo se avanza en la nueva constitución en lo del arbitraje, pero se ignora lo otro, ese nuevo TPP sería perfectamente constitucional… y eso es inaceptable. Porque es tan importante lo del arbitraje como lo de los contenidos.
Un ejemplo, aquí en Inglaterra cuando fue el juicio a Pinochet, cortes formales y permanentes le dieron la razón a Pinochet en toda la primera parte del juicio. Seguían decidiendo que él era inmune frente a los crímenes de lesa humanidad que ocurrieron durante la dictadura. Y eso lo hicieron cortes formales, con jueces permanentes etc. Porque lo que pasa es que existe una legislación, una cláusula, una jurisprudencia y lo que un juez hace es ver ese conflicto desde la perspectiva de esa cláusula y jurisprudencia y por tanto no podemos aceptar que por bueno que sea ese sistema de arbitraje, con el avance parcial que hay, no podemos dejar abierto en las cláusulas, que hayan temas que queden inciertos, que queden abiertos a discusión del punto de vista de que una transnacional que sienta que su rentabilidad o sus utilidades son afectadas por decisiones que tomamos en áreas que son fundamentales.
Cláusulas del Tratado con respeto a la autonomía y sin áreas grises
Recordemos que el Tpp no es el único tratado internacional de ese tipo que buscaba restringir nuestra capacidad, nuestro rango de maniobra en cuanto a política económica, regulación, etc, y los nuevos tratados que se están discutiendo también buscan esa área.
Poor lo tanto es tan importante que en la constitución quede claro que el arbitraje debe ser de un tipo que sea aceptable, como que las cláusulas respeten nuestra soberanía, nuestra autonomía, nuestra democracia y por tanto no queden áreas grises en donde las multinacionales nos pueden llevar a estas cortes y quedar a merced de ellas, que por muy profesionales que sean, todos sabemos como son.
En áreas como el rango de maniobra de política económica, no puede quedar duda que tenemos el derecho absoluto de tomar decisiones de política económica en un rango muy amplio de maniobra. Por lo tanto si el día de mañana se toma una decisión sobre el royalty, de política tributaria o salarial, eso no quede en áreas que puedan ser llevadas a tribunales. Las cláusulas tienen que ser claras, nosotros tenemos soberanía para tomar decisiones en esa área. .
Lo mismo en materia de regulación. Nosotros deberíamos ser totalmente soberanos para tomar decisiones respecto de nuestro medio ambiente, si el día de mañana queremos prohibir un pesticida cancerígeno, no puede ser que terminemos en tribunales y tener que demostrar que es cancerígeno porque todo el mundo sabe que eso es un área gris; probar que un pesticida es cancerígeno o probar que una minera está dañando un glaciar por actividad de la extracción de oro, o probar el daño de antibióticos o el exceso de antibiótico en los salmones, eso no puede quedar en el área gris desde la cual se puede llevar a estos tribunales donde van a estar los abogados que representan a los países de la multinacional en cuestión.
Sobre propiedad intelectual, espacio de maniobra en políticas públicas y apoyo final a Chile Mejor sin TLC
Las cláusulas tienen que tener absolutamente claro según la constitución, que no pueden dejar en duda nuestra soberanía, nuestra autonomía, la capacidad de nuestra democracia a decidir sobre cosas como esa, también en la propiedad intelectual, el problema de la semilla, respecto a la cosa de los fármacos, no podemos quedar a merced de que estos temas pueden ser dirimidos por este tipo de cláusulas
Tiene que ser absoluto reconocer nuestra autonomía como país, como soberanos en este tipo de materias. Lo mismo el espacio de maniobra de las empresas públicas. Otra cosa que el TPP y los otros tratados quieren restringir es la privacidad de la información en internet, lo mismo: no puede ser que esa privacidad quede discutible dentro de los tratados.
En otras palabras, quiero decir que si bien el avance en la parte de arbitraje es importante y necesario, no es suficiente. Tampoco sería suficiente avanzar solo en los contenidos y olvidar lo del arbitraje. Los dos son una especie de mellizos gemelos, los dos están relacionados, pero cada uno tiene su identidad; el tema de los arbitraje y de los contenidos son fundamentales y los dos son tan temas constitucionales el uno como el otro.
Por lo tanto, cerrar una puerta para dejar otra abierta y que nos pasen todos los goles de media cancha que nos quieran pasar, eso no tiene sentido. Por eso lo que les quería pedir, es que por favor aprueben proposiciones como la formulación 2 de la plataforma Chile Mejor sin TLC que precisamente reconoce que existen estos dos temas y que los dos son igualmente importantes y los dos son temas constitucionales, y (apoyen) si hay otras también, que vayan en esa dirección.
En ese sentido, la proposición del señor Daza tiene ese gran problema, que sólo reconoce que existe un problema fundamental, el del arbitraje, en que avanza parcialmente pero avanza mucho, pero por muy bueno que sea ese avance, nos deja totalmente expuestos en el otro.
Por lo tanto les quiero pedir que tomen los dos temas con igual intensidad, porque son de igual importancia el arbitraje y las cláusulas. No podemos dejar que las cláusulas dejen en duda nuestra soberanía, nuestra democracia, nuestra capacidad de decidir lo que nosotros los chilenos y chilenas creemos que es de nuestro interés. Eso es materia nuestra, es decisión nuestra, no puede quedar al arbitrio de otros. En ese sentido para que un tratado sea constitucional tiene que respetar tanto la cosa del arbitraje como la cosa de las cláusulas, eso es lo que les quería enfatizar ahora y ojalá que ello contribuya a la discusión.
