LAS COMPRAS PÚBLICAS

El capítulo de Compras Públicas (Contratación Pública) tiene como objetivo abrir las compras públicas a proveedores de las Partes, esto es: empresas de Chile y la Unión Europea. Este capítulo compromete a las Partes a que sus entidades de contratación brindarán un trato no discriminatorio a los operadores económicos, bienes y servicios de ambas Partes sobre la base de normas sustantivas que aplican los principios de no discriminación y transparencia. Como resultado de la modernización del acuerdo, Chile y la UE abrirán nuevas oportunidades de contratación pública para sus empresas sobre la base de un texto que asume una falacia: que ambas Partes están en igualdad de condiciones para competir en las respectivas licitaciones.
Chile ofrecerá acceso no discriminatorio para las empresas de la UE a los contratos de «concesión de obras», es decir, los contratos que están sujetos a la regulación de concesión de obras públicas en Chile a nivel central y subcentral. Nada indica que ello signifique una mejor calidad de estas obras, ya que los resultados de las licitaciones en el caso de autopistas han sido en varios casos poco satisfactorios. Ahora no sólo se refieren a este tipo de proyectos en el área de transporte sino a cualquier otro, incluidos los hospitales y escuelas.
En cuanto a Oferta de acceso al mercado de la UE, la UE ofrecerá acceso recíproco a proveedores, bienes y servicios chilenos al mercado europeo de contratación pública a nivel central y subcentral. En relación con las concesiones de obras, la UE ofrecerá acceso recíproco a los contratos de concesión de obras adquiridos por entidades centrales y subcentrales, sin ninguna cláusula que compense la disparidad de condiciones económicas, financieras y tecnológicas de las empresas de ambas Partes. Desde luego se verán favorecidas las grandes corporaciones chilenas (muchas de ellas transnacionales) de la minería, el retail o el agronegocio, que son menos del 2% del total de empresas nacionales. Sin embargo, la abrumadora mayoría de las empresas chilenas, clasificadas como medianas y pequeñas, se verán enfrentadas a una competencia desleal. Para fines tributarios, el Servicio de Impuestos Internos de Chile clasifica al 98,6% de las empresas del país como microempresas o pequeñas y medianas empresas. Es decir, el 98,6 % del total de empresas del país son mypymes y un 1,4% del total de empresas chilenas son grandes. En 2020, las compras de entidades públicas en Chile en la plataforma de compras Mercado Público ascendieron a unos EUR 10.700 millones, lo que representó el 4,86% del PIB de Chile y el 17% del presupuesto del Estado en 2020. Esta cifra en la práctica es mayor, pues no incluye las compras de empresas estatales ni las concesiones de obras, rubros a los cuales también accederán las empresas europeas. La citada apertura del mercado de compra y contrataciones por parte de entidades estatales ha sido celebrada como un gran logro por la Parte europea, que de esta manera abre un nuevo mercado a sus empresarios. Sin embargo, no se ha publicado ninguna estimación de las posibilidades de proveedores y contratistas chilenos de participar de forma efectiva en la competencia por las compras y los contratos con las entidades equivalentes de la Parte europea.
Las disposiciones contenidas en este artículo deben considerarse dentro de un conjunto de principios que le dan un carácter restrictivo a la implementación de políticas que impulsen un desarrollo con plena expresión de soberanía para Chile. Estos principios se constituyen en salvaguardias para el mayor desarrollo y competitividad de la Unión Europea frente a la débil y dependiente economía chilena. Estos principios son:
1. Trato nacional que se define como trato no menos favorable que el trato más favorable otorgado en situaciones similares por ese nivel de gobierno a los inversionistas de Chile y a sus inversiones en su territorio, como está señalado en los Capítulos 15 y 17 del Acuerdo Marco Avanzado entre la Unión Europea y Chile.
2. Trato de nación más favorecida que se define como la disposición de cada Parte para otorgar a los inversionistas de la otra Parte y a las empresas que constituyan inversiones cubiertas, trato no menos favorable que el trato que otorga a los inversionistas y sus empresas de cualquier país que no sea Parte con respecto al establecimiento de empresas en su territorio, como está señalado en los Capítulos 15 y 17 del Acuerdo Marco Avanzado entre la Unión Europea y Chile.
3. La prohibición de establecer requisitos de desempeño que se refiere a que Chile no puede demandar a cualquier inversionista, ya sea en importación o exportación, el cumplimiento de algún nivel o porcentaje de contenido nacional, transferencia de tecnología entre otras, como está señalado en los Capítulos 15 y 17 del Acuerdo Marco Avanzado entre la Unión Europea y Chile.
4. La prohibición de expropiación directa o indirecta con excepciones y compensaciones efectivas, como está señalado en el Capítulo 17 del Acuerdo Marco Avanzado entre la Unión Europea y Chile. En este caso lo relevante es la utilización del concepto expropiación indirecta, la que se considera como todas las medidas adoptadas por un gobierno que perjudiquen la rentabilidad de una inversión. Ejemplos de esto puede ser una reforma tributaria o previsional.
5. La libre transferencia de capitales, como está señalado en el Capítulo 17 del Acuerdo Marco Avanzado entre la Unión Europea y Chile.
6. La definición extendida de inversión como “todo activo que un inversionista posee o controla, directa o indirectamente, que tiene las características de una inversión, incluyendo una cierta duración, el compromiso de capital u otros recursos, la expectativa de ganancia o ganancia, o la asunción de riesgo, como está señalado en el Capítulo 17 del Acuerdo Marco Avanzado entre la Unión Europea y Chile. Esta definición de inversión hace tan oneroso el pago de indemnización que hace prohibitiva su aplicación.
7. La obligación de trato justo y equitativo, como está señalado en el Capítulo 17 del Acuerdo Marco Avanzado entre la Unión Europea y Chile, es una disposición que favorece ampliamente a los inversores de la Unión Europea, en tanto invisibiliza la asimetría existente entre ambas Partes del tratado. En la práctica esta obligación de trato justo y equitativo impide la implementación de políticas en favor de pequeñas y medianas empresas chilenas quienes difícilmente puedan convertirse en inversores en la Unión Europea.
En el caso específico de este Capítulo 28:
La definición de “licitación restringida” define un método de contratación mediante el cual la entidad contratante se pone en contacto con un proveedor o proveedores de su elección, lo cual permite en la práctica recurrir a la asignación directa de un proveedor o contratista en desmedro de proveedores o contratistas chilenos con menor capacidad de incidencia. (Subpárrafo g del Artículo 28.1)
En el párrafo 3 del Artículo 28.2 Alcance y ámbito de aplicación, se señalan un conjunto de 9 excepciones a las disposiciones de este capítulo, las que serían condicionadas por un grupo de anexos que no aparecen publicados, con excepción de una lista de Acceso al Mercado de servicios financieros para el caso de Chile, no así de la Unión Europea.
El Artículo 28.3 Excepciones por razones de Seguridad y de carácter general permite reconocer la importancia de la propiedad intelectual para la Unión Europea que tiene acápite propio, a diferencia de la salud pública y consideraciones ambientales. Proteger la propiedad intelectual es una demanda de primera línea de las farmacéuticas y empresas tecnológicas de los países desarrollados y ha sido incorporada en capítulos específicos de otros tratados comerciales internacionales. En este capítulo se utiliza para inhibir la capacidad de los gobiernos de implementar políticas públicas que promuevan un desarrollo autónomo de los países en con menor desarrollo. Disposiciones como la señalada aquí, están presentes a lo largo de la mayoría de los capítulos de este tratado.
En el Artículo 28.4 Principios generales, también titulado No Discriminación, se refuerza el principio de trato justo y no equitativo asegurando que los proveedores y contratantes de ambas Partes reciban un trato equivalente al mejor trato de algún proveedor obtenga. Para que no haya duda alguna, el mismo artículo prohíbe establecer condiciones favorables para la contratación o producción nacional.
En el Acápite Condiciones Compensatorias, Párrafo 6 del mismo artículo se establece la prohibición de solicitar compensaciones a los proveedores o contratados. Esta disposición puede ser interpretada como prohibición de solicitar compensaciones por el daño medioambiental provocado por alguna empresa.
En el Artículo 28.7 Condiciones de participación, Párrafo 4, se excluye la discriminación y el incumplimiento de leyes laborales como motivo para motivo de exclusión de una licitación, situaciones legalmente vigentes en Chile en la actualidad. Esto significa que una empresa europea con la peor reputación respecto de trato de su personal o en materias de género o relacionadas con las disidencias sexuales podrá participar en licitaciones del Mercado Público chileno…y viceversa. Esto es un punto que claramente apunta contra los derechos de los trabajadores y los derechos humanos.
El Artículo 28.11 Consideraciones medioambientales y sociales, es un débil articulado para enfrentar la crisis medioambiental y el incumplimiento de las empresas de las leyes laborales. Reitera la prohibición de compensaciones por el daño provocado.
El Artículo 28.14 Licitación restringida, permite no aplicar una serie de artículos previamente acordados bajo una serie de condiciones con explícita exclusión de la protección de los proveedores nacionales. Esta reiteración es clara señal de la importancia de impedir cualquier tipo de política proteccionista. Y nuevamente se reitera la protección de la propiedad intelectual en uno de los subpárrafos.
El Artículo 28.22 sobre Fomento de la Participación de las Pequeñas y Medianas Empresas (PYMES) solo contempla lo mínimo y evidente, es decir la entrega de información. Son expresiones de buena crianza sin incluir ninguna disposición que sea un efectivo apoyo a la participación de las PYMES en el acceso a las compras y contrataciones públicas.
De igual manera, el Artículo 28.23 Cooperación, no ofrece nada sustancial. No compromete ningún mecanismo de cooperación para la resolución de los problemas que enfrentan los Estados hoy en múltiples ámbitos.
Finalmente, se establece que, en 4 años, las Partes deberán reunirse para proponer al Comité de Comercio recomendar que celebren negociaciones adicionales con miras a lograr una mayor apertura del acceso al mercado. Es decir, aun pueden avanzar más allá agregando nuevas garantías de acceso respecto de las compras públicas que puedan hacer las corporaciones europeas.
En síntesis, el Capítulo 28 Compras Públicas, sólo contempla la liberalización del mercado de compras y contrataciones públicas sin abrir caminos de desarrollo, con el agravante de encapsular al Estado chileno en prohibiciones de implementación de políticas públicas que estimulen el desarrollo de sectores productivos en beneficio de su población. Y favorece a los de siempre, las grandes empresas del área de la minería, agronegocio y el retail, entre otros, que tendrán mejores condiciones para expandir sus exportaciones. No se ve ninguna ventaja concreta para la inmensa mayoría de los usuarios del sistema de Mercado Público.
