Carta a los Cabildos y Asambleas, sobre Demandas Sociales y TPP-11
En este espacio que es el de tu barrio o es el espacio que tú elegiste para participar, hay un tema que no se puede quedar afuera. Se trata del TPP 11, un tratado internacional. El TPP11 ya está aprobado por los diputados y sólo falta que se vote por todos los senadores en sesión plenaria, sin fecha por ahora.
Y si con ese último paso se llegara a aprobar, todo lo que queremos lograr estará en riesgo de antemano, porque existirá un blindaje legal internacional contra todo posible cambio por parte de los inversionistas de las grandes corporaciones mineras, energéticas, forestales, farmacéuticas y de la agroindustria, que podrán demandar al Estado chileno por haberlos “expropiado” y afectado sus expectativas de ganancia. Ese derecho se los da el TPP, una especie de constitución multilateral que asegura férreamente las inversiones de las transnacionales, que a su vez son parte integral del modelo que hizo agua en Chile, destruyendo territorios y calidad de vida y generando esta olla a presión que explotó el 17 de octubre en esta revuelta popular.
Este gobierno y el anterior presentaron el Tratado Transpacífico como un tratado de libre comercio. Pero Chile ya tiene tratados de libre comercio con los 11 países que lo integran, entre los cuales están Japón, Canadá, Australia y Nueva Zelanda, su objetivo no es el bajar aranceles. En realidad, es un tratado, mal llamado de Libre Comercio, que fija nuevas reglas del juego para las trasnacionales en tiempos que a nivel global hay graves problemas. Persigue dar todas las garantías a las inversiones y a los proyectos de las grandes corporaciones como Bayer /Monsanto y a las mineras como BHP, farmacéuticas, forestales y otras como Aes/Gener, y limitar el rol del Estado para que todo siga igual. El TPP es un verdadero candado para impedir los cambios y la soberanía.
En todos los cabildos hablamos de terminar con el sistema actual de pensiones basado en una capitalización individual y no en un sistema solidario; de no más saqueo del agua, de los bajos sueldos y las cuentas abusivas. No queremos vivir asfixiados por deudas del CAE y de consumo ni agobiados por el alto costo de los medicamentos y por las leyes que siempre favorecen a los más ricos. Hoy estamos exigiendo una Asamblea Nacional Constituyente, un mecanismo de participación vinculante para generar una nueva Constitución que nos permita recuperar nuestros derechos. Sin embargo, si el TPP se aprobara ahora y más adelante logramos ejercer estos derechos por ejemplo, derogando el código de aguas y desprivatizándola, rebajando el costo de los medicamentos y subiendo los impuestos a las mineras, o cambiando las leyes laborales por otras que garanticen todos los derechos laborales, estas leyes pueden ser consideradas por las transnacionales como un obstáculo al comercio o una expropiación. Estas corporaciones pueden saltarse nuestra legalidad y demandar al Estado en tribunales internacionales donde la mayoría de las veces ganan los abogados puestos por ellos. Son juicios de fantasía, con los abogados de esas corporaciones haciendo de jueces y deliberando en secreto. Por eso, una eventual aprobación del TPP nos afecta en la salud, las semillas y la soberanía, dificultando aun más el recuperar el agua y la semilla tradicional. El TPP pondría en riesgo el logro de un nuevo Sistema de Seguridad Social con un sistema de reparto basado en pensiones dignas. El TPP sólo reconoce derechos laborales elementales dejando el resto de derechos laborales y las conquistas futuras en riesgo. Si se aprueba el TPP sería difícil levantar estos amarres previos -como los que hizo Jaime Guzmán en la Constitución pinochetista- a una nueva constitución. Hay que exigir al gobierno desechar definitivamente este tratado que apunta a consolidar el modelo.
Su aprobación previa sería una bomba de tiempo para la nueva constitución que buscamos generar. Si logramos acabar con el estado subsidiario y desprivatizar el agua, tener alimentos sanos, educación y salud para todas y todos, lograr no más AFPs y cambiar las reglas del juego para las transnacionales, estas empresas se valdrán del TPP para entablar demandas en tribunales internacionales cada vez que se ejerzan estos nuevos derechos constitucionales y se pongan en práctica las leyes respectivas.
Esperamos que este cabildo o esta asamblea incorpore el #NOALTPP11 a sus demandas, para impedir que se ponga una nueva y sólida camisa de fuerza a los cambios que hoy exige el pueblo.
