 Estimados miembros de la Organización Mundial del Comercio 

Un nuevo corona virus ha causado la pandemia COVID-19 que se ha extendido a casi todos los países. Actualmente se prevé que infectará a millones y causará la muerte de centenares de miles de personas. La Organización Mundial de la Salud ha llamado a los gobiernos a enfrentarla en conjunto, con un enfoque coordinado de gobiernos y sociedad, y a reenfocar su atención para lograr suprimir y controlar el Covid-19.

Muchos gobiernos a nivel nacional e interno ya lo están haciendo. Los gobiernos están trabajando contra el reloj para alcanzar a tratar aspectos de salud que incluyen la escasez de insumos médicos, lo que incluye medicamentos y requerimientos para trabajadores de salud y se están preparando para un shock global de la economía que va a ser más serio que el de la crisis global financiera de 2008. Los equipos gubernamentales están siendo desviados de su trabajo para trabajar en la pandemia y hay negociadores de los tratados y tomadores de decisiones que ya se han enfermado afectados por el coronavirus. 

Los países no tienen suficiente personal ni recursos para enfrentar siquiera los aspectos sanitarios de la pandemia. Estas presiones son especialmente intensas para los países en desarrollo. En todas partes los gobiernos están enfrentando escasez de equipos de diagnóstico y otros insumos médicos, tales como equipos de protección personal que incluyen mascarillas, respiradores, vacunas y medicamentos. Las vacunas y los medicamentos esenciales para tratar el COVID 19 están en ensayo clínico en fase de desarrollo y no está claro si la propiedad intelectual operará como una barrera para su acceso, abastecimiento y posibilidad cierta de compra debido a las obligaciones internacionales aplicadas bajo el Acuerdo de la OMC sobre Aspectos relacionados con los Derechos de Propiedad Intelectual (TRIPS) y los tratados de libre comercio. 

Dada esta clara y urgente prioridad, resulta chocante que todavía la OMC tanto en forma bilateral como regional esté haciendo negociaciones de libre comercio usando tecnologías virtuales. No es posible participar para muchos países en desarrollo o menos desarrollado, dada la brecha digital y dada la necesidad de enfocar todos los recursos del gobierno en la emergencia que vive la salud pública. Los países tampoco tendrían que estar desviando sus recursos para negociar reglas para un mundo que va ser más diferente de lo que podemos imaginar, una vez que la pandemia ceda. 

La primera y única prioridad para los negociadores de tratados de libre comercio en estos tiempos, debería ser dejar a un lado todos los obstáculos, incluidos las disposiciones de propiedad intelectual que existen en los tratados que puedan dificultar el acceso oportuno al abastecimiento de insumos médicos, tales como medicamentos para salvar vidas, aparatos, diagnósticos y vacunas, y la capacidad de los gobiernos para dar todos los pasos que sean necesarios para enfrentar esta crisis. 

Las sanciones unilaterales que impiden a los países obtener insumos médicos esenciales deben terminar. 

Instamos a los miembros de la OMC a dar pasos que aseguren que todos los países puedan flexibilizar y poner a un lado aquellas reglas del comercio que dificultan su capacidad para resolver la crisis sanitaria, sin temor a repercusiones, y a cesar todas las negociaciones y actividades que distraen su energía y sus recursos respecto de aquel objetivo. 

Además los llamamos a reconocer que la pandemia COVID-19 necesita que se reformule el razonamiento tras las reglas que se negocian en los acuerdos de libre comercio, incluidas aquellas que pueden estimular la formación de monopolios y reducir que se pueda tener acceso a todo tipo de abastecimientos médicos, poniendo en riesgo las vidas de las personas de todos los países del mundo.
