Coalición ciudadana se opone a patente del maqui por USACH
La Red de Acción en Plaguicidas RAP-Chile participó hoy en la entrega de una acción legal de la Fundación Chile Sustentable ante el Instituto Nacional de la Propiedad Industrial INAPI, para impedir el patentamiento del maqui por la Universidad de Santiago de Chile y entidades internacionales. Se entregaron antecedentes jurídicos e históricos respecto del uso de esta planta nativa, parte del patrimonio genético y espiritual del pueblo mapuche. La legislación chilena actual no permite patentar el conocimiento ancestral, pero de aprobarse el Tratado Transpacífico TPP, el país estaría obligado a legalizar la llamada “biopiratería” y se ampliará paralelamente el proceso de privatización de la semilla, incluyendo las plantas medicinales y sus derivados. El lobby de las industrias transnacionales de la biotecnología y farmacéutica funcionó efectivamente en este sentido durante la negociación del tratado, secreto para el resto de los interesados, incluido el parlamento chileno.
Coalición denuncia biopiratería
La acción de oposición legal cuenta con el respaldo de la Coalición de Defensa del Maqui, integrada inicialmente por más de 200 organizaciones ciudadanas, así como por personalidades y políticos, alarmados ante esta solicitud de patente, así como por los intentos desplegados en paralelo ante el Servicio Agrícola y Ganadero SAG por la Universidad de Talca y la Fundación Chile para contar con derechos de obtentor sobre variedades del maqui. Estas pretensiones son calificadas como “biopiratería” por los Conadi; los senadores Eugenio Tuma y Alfonso De Urresti; Sara Larraín y María Isabel Manzur de Chile Sustentable; Lucia Sepúlveda y María Elena Rozas de RAPAL; Claudia Mellado Ñancupil de la Red de Semillas Libres del Wallmapu, y los abogados Salvador integrantes de la coalición, representada por Emilia Nuyado, consejera nacional de Millaleo y Carlos Urquieta. La Coalición estima que la solicitud no demuestra invención alguna, sino sólo una extracción de sustancias naturalmente presentes en el maqui. Y en el caso de la presentación para el registro de derechos de obtentor, a objetarse posteriormente, no se cumple con los requisitos legales de ser “nueva” y “distinta”, ya que las muestras fueron recolectadas en diversas zonas donde existen selecciones naturales realizadas por las comunidades. Los cambios se refieren al sistema de propagación (por clonación) y no a la planta en sí misma.
Aplicación anticipada de normas del TPP
Lucía Sepúlveda, encargada de semillas de la Red de Acción en Plaguicidas RAP-Chile señala: “La privatización del maqui se está haciendo mediante investigaciones realizadas con fondos públicos, y constituye un despojo para las comunidades que desde tiempos ancestrales han realizado su selección y recolección. Ello pasará ahora a manos de la agroindustria para su comercialización y uso medicinal o nutricional, desplazando progresivamente a los pequeños recolectores que no recibirán beneficio alguno de estas patentes y/o registros. Estos organismos públicos actúan como si ya se hubiera aprobado el Tratado Transpacífico TPP, que efectivamente incluye en el capítulo de Propiedad Intelectual normas que apoyan la biopiratería y el patentamiento del conocimiento ancestral. También el TPP incluye el registro de plantas medicinales a través del Convenio UPOV 91, asociado a una nueva Ley de Obtentores que facilitará el registro de todas las variedades. Junto a las organizaciones indígenas y campesinas, y a la Plataforma Chile Mejor sin TPP, rechazamos este tratado y más aun su aplicación anticipada”. María Elena Rozas, coordinadora nacional de RAP-Chile agregó: “Hasta ahora el maqui es un fruto de recolección silvestre, pero ya fuimos advertidos en la mesa público-privada del Ministerio de Salud sobre Límite Máximo de Residuos de Plaguicidas, que desde el próximo año los cultivos de maqui tendrán manejo agronómico por ser monocultivos. Se usarán insecticidas, fertilizantes y otros químicos, por tanto esto es también un atentado a la salud de un alimento que es sano y que con ello dejaría de ser natural.”
La experta en biodiversidad, recursos genéticos y agricultura sustentable María Isabel Manzur expresó que “el patentamiento de sustancias antioxidantes y anti bacterianas del Maqui viola completamente los derechos de los pueblos indígenas y también es contraria a la legislación nacional. La Ley de Propiedad Industrial, la Ley Indígena y el convenio 169 reconocen los conocimientos y productos tradicionales de las etnias y, la Convención de la Diversidad Biológica establece que si alguien necesita utilizar algún producto originario de comunidades locales o indígenas tiene que haber un consentimiento informado previo y aquí no ha existido nada de eso”.

Claudia Mellado, de la Red de Semillas Libres del Wallmapu y de ANAMURI, Asociación Nacional de Mujeres Rurales e Indígenas acota: “El maqui para nosotros es más que un producto alimenticio, de medicina y utilizado en productos artesanales. Es también una fuente de energía vital para nuestro Rehue, es una planta ceremonial y espiritual sumamente importante para nosotros. Que hoy en día se esté buscando patentar el maqui es más que atentar contra la vida, es atentar contra nuestra espiritualidad”.
El senador Tuma manifestó que los reales titulares de los beneficios, conocimientos y usos del maqui deben ser las comunidades. Respecto a la solicitud de rechazo de la patente hecha hoy por las organizaciones sociales al INAPI, el senador Alfonso De Urresti expresó que las organizaciones ambientales y sociales que han alertado sobre esta situación estiman que las solicitudes de derecho de obtentor solicitadas, no cumplen con el requisito básico de ser productos nuevos, “pues el Maqui es ampliamente comercializado en Chile y es de uso ancestral en el país”. Agregó que en el extranjero se registraron anteriormente la murtilla y un hongo originario de Rapa-Nui del cual se extrae la Rapamicina, este último patentado por un laboratorio canadiense, sin consentimiento previo ni reparto de beneficios con los Rapa Nui.
