Declaración Pública| Manipulación política de gobierno sobre negociaciones Acuerdo Chile/Unión Europea

A días de las elecciones presidenciales y en medio del desarrollo de la Convención Constitucional, la Subsecretaria de Relaciones Económicas Internacionales (SUBREI) del Gobierno de Chile publicó que las negociaciones de la modernización del Acuerdo de Asociación entre Chile y la Unión Europea fueron finalizadas.

Como Chile Mejor sin TLC sostenemos que, en primer lugar, dicha publicación presenta una redacción por lo menos engañosa, ya que si bien la negociación técnica del acuerdo se dio por terminada, en la Unión Europea no existe acuerdo político que respalde la conclusión de las negociaciones. 

En segundo lugar, acusamos una abierta manipulación política en lo informado por la SUBREI del Gobierno de Chile, puesto que esta finalización técnica de las negociaciones no implica en ningún sentido que no se puedan realizar cambios en en la modernización del acuerdo. 

Dicho esto, cabe aclarar que uno de los países a los que se acusa de bloquear la modernización de este acuerdo es Francia, cuya postura se basa en la oposición al tratado por parte del sector agrícola del país. Tal como en Chile la férrea defensa de la semilla y la lucha por la soberanía alimentaria ha sido una barrera para la profundización de la privatización y el despojo, en Europa las agricultoras y agricultores se resisten a este tratado que afectaría gran cantidad de los derechos que han ganado. 

La firma de esta modernización del acuerdo significa establecer un Sistema de Corte de Inversiones, sistema que otorga a inversores internacionales el derecho unilateral de demandar a los estados toda vez que sus decisiones interfieran con sus expectativas de ganancia, dando la posibilidad de exigir indemnizaciones millonarias. Esta corte, cuya jurisprudencia estará por encima de los tribunales nacionales, seguirá asegurando a los inversionistas extranjeros por más de 20 años tras una eventual retirada del acuerdo.

Nos parece necesario recordar que la misma Unión Europea reconoció que la modernización del acuerdo económico provocará daños ambientales en nuestro país y que las ganancias económicas para Chile son marginales. Asimismo, distintos países de la Unión Europea reconocen aprovechar la situación actual del país y el próximo fin del mandato de Piñera para amarrar este acuerdo, ya que saben que un nuevo gobierno no tendrá la misma disposición para modernizar este tipo de tratados. 

Afirmamos también que este acuerdo comercial que las autoridades presentan como ecológico y beneficioso, desde la perspectiva del pueblo de Chile, carece totalmente de estas cualidades. Los países de la UE, espcialmente Alemania, están muy interesados en aprobar este acuerdo, particularmente por las materias energéticas, la razón es que Chile pasaría a ser exportador de hidrógeno verde, es decir, transición energética para Europa y profundización del extractivismo para Chile.

Una vez más la participación de la sociedad civil y del Parlamento en este proceso ha sido nula. El equipo negociador del Gobierno dio por terminada esta política pública relevante sin rendir cuenta a la ciudadanía ni a los congresistas. La apreciación del país respecto a los tratados de libre comercio ha cambiado sustantiva y legítimamente durante los últimos cinco años, por lo que es totalmente necesario someter a debate los tratados comerciales internacionales. 

Es evidente que en las actuales condiciones políticas, con un presidente con los peores niveles de aprobación popular de la historia reciente el Gobierno no está en condiciones ni tiene la autoridad para tratar de imponer un tema que es conflictivo. 

Exigimos a las actuales autoridades detener las negociaciones o tramitaciones de todos los tratados de libre comercio e inversión. Instamos a las autoridades que sean electas a revisar exhaustiva y democráticamente cada acuerdo comercial y denunciar los que resulten dañinos y contrarios a lo que dicta la soberanía popular. 

Por último, llamamos a las organizaciones sociales a estar atentas a lo que suceda con la modernización del Acuerdo de Asociación de Chile y la Unión Europea, puesto que contendrá aspectos que ya han sido criticados en otros acuerdos, como el TPP-11.
