TLC entre Chile y Argentina: Fundamentos que no han sido entregados a los parlamentarios por las cancillerías de nuestros países

En noviembre de 2017, Chile y Argentina firmaron un Tratado de Libre Comercio (TLC) que extiende el Acuerdo de Complementariedad Económica (ACE) N°35 vigente desde 1996. Este nuevo TLC ha sido presentado simplemente como un nuevo “marco regulatorio” en la relación bilateral, inocuo y sin peligros, que simplemente “profundiza y extiende el marco jurídico bilateral del espacio económico” ya regulado por el ACE N°35. Efectivamente, se trata de un TLC que no modifica la sustancia del comercio entre Chile y Argentina.

Entonces nos preguntamos, ¿cuál es el sentido de este Tratado de Libre Comercio si no modifica las condiciones del comercio entre ambos?

La respuesta es clara. Los Tratados de Libre Comercio son mucho más que tratados sobre el comercio entre países. Estamos en realidad hablando de tratados que avanzan en la desregulación y liberalización de amplias actividades económicas que en las últimas décadas han estado en mano de los Estados, como los servicios públicos (provisión de servicios básicos, educación salud, sistema de pensiones, correo, transporte en general, etc.), las telecomunicaciones y las compras públicas. Esas actividades pasan cada vez más a manos privadas sobre la base de que sólo “Estados modernos”, pequeños y ágiles, atraerán la inversiones a nuestros territorios. Entonces, los TLC son la herramienta legal de las fuerzas privadas que empujan por una apertura económica indiscriminada en nuestros países. Los Tratados vienen a cristalizar el rol del sector privado en nuestras actividades productivas y sociales cotidianas, plasmando a los ciudadanos como meros “consumidores” o “usuarios”, sin derechos.

Por ello, rechazamos un tratado que es presentado como inocuo, sin peligro e incluso “moderno”, cuando en realidad viene a reafirmar los privilegios de las empresas transnacionales en nuestros territorios, quitando cada vez más derechos a los ciudadanos y ciudadanas. Esto se logra mediante cláusulas que comprometen a los Estados en materia de inversiones, de comercio electrónico, de servicios y telecomunicaciones, mientras que los capítulos “nuevos” como los de Género, Medio Ambiente, Laboral y Micro, Pequeñas y Medianas Empresas (MiPyME) son simplemente un cúmulo de palabras con buena voluntad pero con ninguna capacidad de influir de modo real sobre la política de ambos Estados.

Entonces, ¿por qué nos oponemos a este Tratado? Aquí 5 puntos centrales para decir NO al Tratado de Libre Comercio entre Chile y Argentina.
