TPP11 al TC gracias a Senador Bianchi, 42 diputados, y presión ciudadana

Karim Bianchi, senador independiente por Magallanes, lideró con valentía y dignidad la moción que el miércoles 19 de octubre ingresó  el TPP11 al Tribunal Constitucional. Nunca antes  en Chile había sido cuestionado de esta manera un Tratado Internacional de Libre Comercio, lo que ocurre al objetarse la  forma en que se pretende aprobar el Sistema Internacional de Resolución de Controversias, el ISDS por su nombre en inglés. El cuestionado mecanismo que entrega jurisdicción nacional a las cortes internacionales, saltándose los tribunales del país,  es parte de las garantías a la inversión contenidas en las cláusulas del  Tratado Integral y Progresivo Transpacífico.    Desde Chile Mejor sin TLC ello fue valorado como un importante logro. La plataforma continuará apoyando esta iniciativa y otras orientadas a frenar  al tratado en los territorios, tal como fue anunciado  tras la votación del día 11 de octubre. En esa oportunidad,   el senador Bianchi formuló  la reserva de constitucionalidad por incumplirse en la tramitación del TPP11 por el congreso,  la consulta a la Corte Suprema, que era obligatoria dada la delegación de sus funciones constitucionales. Ello se funda en los artículos 59 y 60 de la Ley Orgánica Constitucional del Congreso Nacional.

En dos días,  el senador por Magallanes   había conseguido en el Senado sólo 12 de las 13 firmas requeridas. Al fin del plazo legal, activó un Plan B que tuvo éxito inmediato. Su gestión, acompañada por intensa  presión ciudadana sostenida por Chile Mejor sin TLC y múltiples voces de resistencia al tratado en redes sociales de todo el país, permitió  abrir el camino para  que la moción  fuera presentada desde la Cámara de Diputados, lo cual requería 39 votos. Se produjo un raudo avance de patrocinios  por parte de la cámara baja, completándose al mediodía 42 votos.  La diputada independiente Camila Musante representará la moción ante el Tribunal Constitucional. En la recolección de firmas  colaboró activamente, entre otros,  el diputado por Valparaíso, doctor Tomás Lagomarsino.  La lista de firmas incluye a diputados independientes, así como a miembros de Apruebo Dignidad y otros partidos.  Por orden alfabético ellos son:

Ellos representan más de la cuarta parte de los diputados en ejercicio de sus cargos, según señala en el documento respectivo el secretario general de la Cámara de Diputados.

La moción de inconstitucionalidad plantea esencialmente que el congreso omitió consultar a la Corte Suprema respecto de la delegación de la jurisdicción de justicia en cortes internacionales, lo cual es exigible legalmente. Ello significó  un total revés para el senador Insulza que ejerció fuertes presiones sobre los senadores de su partido, logrando inhibir la firma incluso del senador Alfonso de Urresti, quien había votado anteriormente en contra del TPP11, el pasado 11 de octubre.    Hubo sin embargo 10 senadores que mantuvieron su posición en contra.Ellos fueron Karim Bianchi,  Fabiola Campillai, Claudia Pascual, Daniel Núñez, Yasna Provoste, Francisco Huenchumilla, Juan Ignacio Latorre, Iván Flores, Fidel Espinoza y Alejandra Sepúlveda,    Ese número es igual al de quienes votaron a favor, sin embargo en lugar de Urresti completó esa decena el senador demócrata cristiano Iván Flores (región de Los Ríos) reemplazando a De Urresti. 

 

El avance de la moción significó  un total revés para el senador Insulza que ejerció fuertes presiones sobre los senadores de su partido, logrando inhibir la firma incluso del senador Alfonso de Urresti, quien había votado anteriormente en contra del TPP11, el pasado 11 de octubre.    Hubo sin embargo 12 senadores que mantuvieron su posición en contra. Ellos fueron Karim Bianchi,  Fabiola Campillai, Claudia Pascual, Daniel Núñez, Yasna Provoste, Francisco Huenchumilla, Juan Ignacio Latorre, Iván Flores, Fidel Espinoza,  Alejandra Sepúlveda y Esteban Velásquez.    En  lugar de Urresti completó la docena el senador demócrata cristiano Iván Flores (región de Los Ríos). Y se agregaron los senadores Esteban Velásquez, del FRVS y Loreto Carvajal (PPD) que no votaron el 11, al igual que Flores que estaba ausente de Chile. Los votos en contra contabilizados el 11 de octubre sólo fueron 10 (y 27 a favor) con numerosos pareos y ausencias.  

Mientras se recolectaban las firmas de diputados para el “plan B” del senador Bianchi en las redes sociales se daban a conocer los nombres de  los senadores del oficialismo que negaron su firma, varios de ellos del Partido Socialista, entre ellos De Urresti (PS) 11 e Isabel Allende (que no votó el 11). Jaime Quintana (PPD) se abstuvo el 11, y no firmó la moción, al igual que  Ximena Ordenes (PPD).

El UPOV 91 y el Tribunal Constitucional

El 26 de  junio de 2011 (durante el primer gobierno de Sebastián Piñera)  el Tribunal Constitucional, presidido entonces por Marcelo Venegas,  falló por 6 votos contra 4  a favor de la constitucionalidad del convenio internacional UPOV 91 que también ha sido mencionado en la discusión actual del Senado sobre el TPP11. De la misma manera existe una objeción adicional, que es la no realización de la consulta indígena mandatada por el Convenio 169 de la OIT.

El fallo sobre el UPOV 91 Incorporó sin embargo una prevención respecto de los derechos del pueblo mapuche, pese al rechazo de  la moción presentada el 8 de junio por el entonces Senador Alejandro Navarro. El contó entonces con la firma de 17 de sus pares, entre otros el actual senador Jaime Quintana. Ello se dio tras la aprobación de ese convenio relativo a la semilla y las garantías que allí se establecen en favor de los obtentores vegetales, es decir quienes registran variedades vegetales como propias en el SAG y manejan monocultivos de semillas transgénicas y convencionales.  Más de 40 organizaciones y empresas fueron  recibidos en audiencia pública por la entidad, previo al fallo. Allí expusieron ANAMURI, OLCA y la campaña Yo No Quiero Transgénicos en Chile,  junto a diversas organizaciones de los pueblos mapuche y aymara entre otras organizaciones sociales. También lo hicieron las  empresas trasnacionales, como Monsanto, y académicos.

El resultado  fue un triunfo relativo de Monsanto y las corporaciones exportadoras de semilla transgénica y convencional.   Es asíporque más de una década después, Chile sigue fuera del UPOV 91,  siendo parte del convenio UPOV en su versión del año 78.  Para adscribirse a los artículos del año 1991 (UPOV 91),  se requería  derogar la actual Ley de Semillas y aprobar una nueva que incorpore esas disposiciones. Una sostenida oposición de organizaciones campesinas, indígenas y socioambientales defensores de la semilla tradicional, la biodiversidad y anti transgénicos ha impedido el avance de sucesivos proyectos de una Ley de Obtentores Vegetales por parte  de gobiernos de la concertación y de Sebastián Piñera.

El año 2014 la recién asumida Presidenta Michelle Bachelet retiró de tramitación el proyecto que estas organizaciones habían bautizado como Ley Monsanto.  Sin embargo el capítulo de propiedad intelectual del TPP origina,  firmado en noviembre de 2015 por la Presidenta Bachelet obliga a los países miembros a adscribirse al  UPOV 91. Ese artículo continúa plenamente vigente en el TPP11 aprobado actualmente por el Congreso, por lo cual la amenaza sigue en pie, en el sentido de la presión que existirá por el gobierno para avanzar en esa ley.  Para las organizaciones campesinas el avance de esa legislación implica consolidar el modelo privatizador de la semilla, impedir su libre uso,  circulación e intercambio y dañar los esfuerzos de productores agroecológicos para recuperar semillas tradicionales y poder  contar con alimentos producidos a partir de semillas y cultivos libres de plaguicidas y transgénicos.

En estos días circula ampliamente una carta abierta al Presidente Boric, de comunidades indígenas y pequeña agricultura campesina, sobre el plan nacional anunciado por el  ministerio de Agricultura referente al resguardo de semillas y razas para la soberanía alimentaria. La participación de INIA en el plan,  implica el uso de la semilla tradicional como mercancía transable con empresas transnacionales o del país.  Ello puede verse además como paso previo para la presentación por el gobierno actual de una nueva Ley de Semillas que permita cumplir las exigencias del TPP11.   Zunilda Lepín Henríquez (Zuny), declarada oficialmente Tesoro humano vivo en 2015, cuidadora de semillas y cocinera tradicional una de las voces en contra, se dirigió a las guardadoras de semillas antiguas en los siguientes términos: “Llamo  a no entregar su semilla a ninguna institución, hasta que no nos digan qué semillas tienen guardadas y nos las devuelvan para sembrar libremente como siempre lo hicimos y como debe seguir. Ahí están las semillas de nuestras abuelas, ellas se fueron a la tumba sin recuperarlas, nosotros debemos luchar por su legado”.
