TPP: Tenemos un país paradojal

lucio_cuencaEl 4 de febrero, en Nueva Zelanda la presidenta ratificará la firma del TPP, dejando como única vía de escape a la mayor cesión de soberanía que haya hecho nuestro país, al parlamento, el que podrá de manera plebiscitaría votar por la validación o no de este acuerdo secreto, confeccionado a espaldas de la ciudadanía y de las y los legisladores de los doce países firmantes, pero con la participación activa de 600 lobistas de las principales transnacionales del planeta.

Esto, sucede en paralelo a las sesiones del Comité de Observadores del proceso constituyente gubernamental, designados por la presidenta para garantizar la buena fe del mismo, en medio de la más contundente crisis de credibilidad que haya experimentado la clase político/económica del país… en un intento de idear mecanismos de legitimidad para satisfacer las demandas comunitarias.

Claramente esta forma de proceder habla de una esquizofrenia gravísima, que tiene que ser diagnosticada y tratada. Es decir, durante el 2013 se desarrollan sendas movilizaciones contra la Ley Monsanto, que privatizaba la semilla, y lo primero que hace Bachelet candidata y luego presidenta, “escuchando” a la ciudadanía es bajar la ley, pero mientras su gobierno seguía  negociando por detrás el TPP, que entre las miles de barbaridades que implica, supone la aprobación de facto de la ley Monsanto.

Otro ejemplo, la ley de glaciares. Desde las movilizaciones contra Pascua Lama emergen los glaciares en el debate público, justo en un contexto de calentamiento global que impone su reguardo y protección. Siendo Chile el país que posee el 91% de los ecosistemas glaciares de América Latina, y uno de los más vulnerables a la crisis climática, comienzan a surgir diversas iniciativas parlamentarias de protección, se decanta un proyecto común el 2014,  y en la cuenta anual de ese año ante el parlamento (fuera de programa) la presidenta se compromete a legislar por su protección, el Ejecutivo nuevamente aparece comprometido a salvaguardar los glaciares, otra vez “escuchando” a la ciudadanía.  Sin embargo,  despacha luego una indicación sustitutiva que en la práctica legaliza la destrucción en beneficio del extractivismo minero.

Otro ejemplo. En la medida que los impactos de la Megaminería química comienzan a hacerse evidentes: escasea el agua, aumentan las tasas de enfermedad  y  muerte en los distritos mineros,  se desnudan los casos de corrupción, demostrando lo que las comunidades siempre han dicho, es decir, que las aprobaciones medioambientales son políticas y no técnicas… en fin, se visibiliza la insostenibilidad de país extractivista que se nos ha impuesto… Sale en escena Ricardo Lagos junto a los principales actores del Consejo Minero, Jean Paul Luksic incluido, para hacer entrega a Bachelet de una nueva plataforma minera para el país, que al igual que el TPP se fragua durante un año en completo secreto, y se internaliza como política de Estado sin que haya sido parte del programa de gobierno ni haya existido debate alguno sobre los contenidos que dicha plataforma propone. Este documento habla de Minería Virtuosa, sostenible e inclusiva, bajo el eje de la colaboración público privada, o sea, lindas palabras para posibilitar la intromisión descarada de las transnacionales en el destino de nuestras reservas estratégicas, desde el propio Palacio de la Moneda.

Dicho sea de paso, el TPP inhabilita en la práctica el que la gente se oponga a proyectos de inversión cuando sienta sus derechos violentados, pues impone un mecanismo internacional de resolución de controversias, mediante Tribunales Económicos, a los que pueden ser llevados los Estados que muestren voluntad de poner los derechos de las personas y de los ecosistemas por sobre un proyecto de inversión comprometido, de modo tal de ser obligados a indemnizaciones millonarias, financiadas con el erario público para beneficio privado… el principio de ganar ganar a escala supranacional.

La esquizofrenia que padece Chile es grave, y para nosotros, el proceso constituyente que el devenir político y social ha logrado ir abriendo, puede constituir una posibilidad de tratamiento, menos inoficioso que los electro shock que está planificando el Ministerio de Energía. No obstante, para que esto ocurra es imprescindible tomar en serio el desafío, no el gobierno -que aún no entiende el desafío- sino todas las voluntades que efectivamente se atreven a pensar que las cosas pueden ser distintas… ¿cuán distintas? Eso depende de cada uno y una de nosotros. Mientras dejemos que se siga estableciendo sin cortapisas cuestiones como que los 216 facilitadores del proceso constituyente deben ser profesionales y pueden pertenecer a partidos políticos… no parece que demasiado distintas, como si la tecnocracia y el pragmatismo no pudieran dejar de regir nuestro destino… sin embargo, es nuestra convicción que atreviéndonos a participar de las discusiones, atreviéndonos a conocer la Constitución que nos rige, atreviéndonos a validar el conocimiento que tenemos sobre el país en el que nos hemos constituido y el que queremos constituir realmente… más allá del formalismo con que siga actuando la casta política, incubaremos cambios que terminen por dejar sin efecto el altísimo grado de disociación existente entre representantes y representados… o sea, que nos vayan sanando poco a poco de la esquizofrenia, sin químicos, sino naturalmente, con las raíces que crecen en nuestro suelo.

Claro que de poco servirá un nuevo marco constitucional empoderado, una nueva ley de glaciares, un nuevo código de aguas, una nueva modificación del Sistema de Evaluación de Impacto Ambiental aunque logremos que sirva a las comunidades y no a los lobistas de turno, si es que no nos ponemos en campaña severa de frenar el TPP, que se constituiría en una camisa de fuerza invalidante de cualquier legislación interna que escuche a la ciudadanía.
