El grupo económico francés Suez, controlador de Essal, amenaza con iniciar arbitraje internacional de inversiones si la Superintendencia de Servicios Sanitarios (SISS), se niega a decretar la nulidad administrativa y la suspensión del procedimiento administrativo de caducidad de la concesión que lleva adelante este organismo contra Essal.
Cabe recordar que el proceso de caducar la concesión se inició debido a que, durante julio de 2019, la empresa mantuvo sin suministro de agua potable durante más de una semana a 180.000 personas de la ciudad de Osorno, primero por un derramamiento de petróleo en una de sus plantas y luego por hallarse bacterias fecales en el agua tratada.
La firma internacional acusa que las actuaciones del organismo regulador infringen principios básicos del debido proceso y ponen en duda la seguridad jurídica de las inversiones extranjeras en Chile. Además, a través de un escrito da por terminadas las consultas amistosas con el gobierno de Chile “a efectos de, en un futuro, someter la controversia a un arbitraje internacional ante el Banco Mundial, de conformidad con el acuerdo suscrito entre el Reino de España y la República de Chile para la protección y fomento recíprocos de inversiones”.
La empresa causante de una grave crisis sanitaria hoy argumenta que “Chile no es confiable para las inversiones”, de esta forma evitan hacerse responsables de la contaminación y así someterse a las sanciones que el Estado de Chile debe ejercer por haber incumplido el contrato de buen servicio en agua potable. “Quieren transformarse en víctimas y denunciar al Estado de Chile para no asumir los costos, al contrario que se les compense por supuestas pérdidas económicas”, expresa Lucio Cuenca del Observatorio Latinoamericano de Conflictos Ambientales y agrega que: “esto es posible por los TLCs y acuerdos de protección de inversiones que Chile ha suscrito, y que pretende profundizar con los Tratados de nueva generación”.
Para Esteban Silva de la Fundación Constituyente XXI, la amenaza de Suez de llevar a arbitraje internacional a Chile por caducar la concesión es la prueba más clara de por qué es necesario revisar, suprimir y reestructurar los tratados que tengan aspectos de protección de las inversiones extranjeras, lo que es muy relevante en este periodo de pandemia y también en la post pandemia desde el punto de vista de la recuperación de la soberanía económica de Chile que ya se ve afectada por la recesión. “Acá hay un ejemplo específico de por qué hemos hecho tantas gestiones para que el Senado rechace el TPP-11”, concluyó Silva.
Igualmente para Lucio Cuenca lo que sucede con esta firma francesa, “es el preámbulo de lo que sucederá con otros acuerdos de libre comercio y de Inversión como TPP 11, Acuerdo UE y otros, cuando Chile quiera ejercer acciones para defender o mejorar los derechos de la ciudadanía de nuestro país, como el Derecho Humano al Agua”.
