Chile Mejor sin TLC a los países del TPP11, inversionistas y los pueblos de Chile: Nunca votamos el TPP11! ¡Aprobamos resistir!

Nuestra Carta Lateral 

1.-        La aprobación del Tratado Transpacífico, TPP11 no es fruto de un masivo apoyo ciudadano sino de la presión de la derecha, los medios opositores,  las grandes corporaciones, la UDI, RN y Evópolis  y aliados, como los senadores José Miguel Insulza y  Ricardo Lagos Weber. Son los mismos que obstaculizan hoy la voluntad de millones de chilenos de cambiar la Constitución pinochetista.  El Presidente Boric  dio la espalda a su programa, que no incluía el TPP11, y  planteaba una amplia participación ciudadana para definir estos temas. Las 28 urgencias planteadas post estallido social por el gobierno de Piñera no impidieron que se congelara de hecho esta votación. Sin embargo ahora el Presidente no escuchó a  los movimientos sociales de trabajadores, ecologistas, mujeres y jóvenes, ni a centenares de organizaciones populares que lo llamaban a usar sus facultades para retirar el proyecto. Optó en cambio por dar  luz verde a un Senado con mayoría opositora y escasa credibilidad social. El tiempo dirá si el Presidente usó este tratado como moneda de cambio para lograr el voto de la derecha para su agenda legislativa, hipotecando el futuro de todas y todos a cambio de supuestos apoyos para reformas puntuales.

2.- El ejecutivo y el Congreso no cumplieron tampoco la obligación de llevar adelante la Consulta Pública a pueblos indígenas mandatada por el Convenio 169 de la OIT.  Así, el 11 de octubre se aprobó el TPP11 con  sólo 27 votos a favor, 10 votos en contra de la coalición de gobierno Apruebo Dignidad, junto a senadores independientes y  del PS y PDC; 1 abstención y 10 deplorables ausencias. Esa débil mayoría equivalente a un 54% del total de votos  emitidos en  un Senado con 50 miembros, logró instalar una especie de constitución global de las corporaciones transnacionales,  con falsas promesas de beneficios inmediatos para paliar la cesantía, la inflación y el estancamiento,

La Cámara de Diputados ya había aprobado el TPP11 con un inédito y escaso margen, en abril de 2019 (77 a favor, 68 en contra y 2 abstenciones). Ambas votaciones evidencian que en Chile ya no hay aprobaciones automáticas de tratados que vulneran la soberanía nacional y derechos de comunidades y trabajadores.   En julio de 2019, para nuestro plebiscito autoconvocado, casi un millón de personas  ya votó,  rechazando el TPP11.

3.- El  Senador independiente Karim Bianchi hizo presente una reserva constitucional señalando  que la Corte Suprema no ha sido consultada sobre la delegación de la administración de justicia  a manos de tribunales internacionales. La  canciller  Antonia Urrejola, ex asesora del senador Insulza en la OEA  y principal impulsora del Tratado, evitó ilustrar al Senado con su conocimiento y manejo de la institucionalidad internacional de Derechos Humanos, así como de los reclamos y demandas interpuestos por derechos de Pueblos Indígenas.  Sólo  intervino al final,  para informar   que el gobierno esperará el avance de las cartas laterales para ratificar el acuerdo.

4.- Chile Mejor sin TLC precisa que en vez de ceder a nuevas presiones del Senado para acelerar el depósito del Tratado,  el Presidente Boric debe llevar adelante con los otros 10 países miembros,  la negociación de cartas laterales sobre Resolución de Controversias y  derecho del Estado a crear empresas públicas. La temática de las cartas laterales coincide con algunos de los puntos críticos denunciados por nosotros desde 2015 con el antiguo TPP. Nuestras objeciones probaron ser fundadas. También llamamos al Presidente a acompañar ese proceso llevando adelante la participación ciudadana prometida, posibilitando contar con informes independientes sobre los alcances e impactos del TPP11. Al mismo tiempo es necesario que el gobierno inicie una auditoría integral e independiente respecto de los resultados que más de 30 años de libre comercio han tenido para Chile, sus habitantes y territorios.

5.- Los 10 senadores que llevaron adelante el  voto  #NOalTPP11  fueron  Fabiola Campillai y Karim Bianchi (independientes); Daniel Núñez y Claudia Pascual (PC); Alfonso de Urresti y Fidel Espinoza (PS); Yasna Provoste y Francisco Huenchumilla (PDC); Juan Ignacio Latorre (FA),  y Alejandra Sepúlveda (FRVS).  Rechazaron la pérdida de soberanía nacional, pues las empresas pueden demandar en  tribunales internacionales al Estado  aduciendo pérdidas en sus expectativas de ganancias por normas o leyes.  Exigen centrarse en discutir    la estrategia de desarrollo e industrialización, considerando un contrasentido hablar de aumentar la agroexportación ante  la grave crisis alimentaria derivada de la disminución de la superficie de siembra.

6.- Votaron a favor del TPP11 y la entrega de la soberanía los senadores José Miguel Insulza (PS); Ricardo Lagos Weber (PPD) y Jorge Soria (ind. Pro PPD); Pedro Araya y  Matías Walker (DC), Ximena Rincón (ex DC); los UDI  Juan A. Coloma, E. van Risselberghe, José Durana, Luz Ebensperger, Sergio Gahona, Gustavo Sanhueza,  Iván Moreira, David Sandoval y Carlos Kuschel (UDI). Los votos RN fueron de Rafael Prohens, M.José Ossandón, Rodrigo Galilea,  Juan Castro P, García Ruminot, Carmen G. Aravena,  M. José Gatica, y Alejandro Kusanovic.  Por Evópolis rechazaron Luciano Cruz Coke,  Sebastián Keitel,  Felipe Kast. Se abstuvo Jaime Quintana (PPD).   De la coalición oficialista se ausentaron evidenciando poco respeto por el debate y por sus votantes, Isabel Allende, Loreto Carvajal, Esteban Velásquez, Iván Flores, Gastón Saavedra y Ximena Ordenes.  Alvaro Elizalde  fue notificado por COVID durante la sesión.  En la derecha, eludieron su responsabilidad política Rojo Edwards, Paulina Núñez y Kenneth Pugh. Los días previos a la votación,  todos los senadores y también el Presidente Boric, fueron destinatarios de mensajes de las y los ciudadanos desde nuestra web, con la herramienta informática Lista Negra Parlamentaria.

7.- Como Plataforma Chile Mejor sin TLC, llamamos a impulsar una nueva fase de resistencia al Tratado, apoyando  acciones en la calle o el Tribunal constitucional  para impedir o diferir su promulgación por el Presidente.  Es clave hacer educación popular sobre la relación entre este tratado  y el presente y futuro de todas y todos, dadas las no resueltas demandas sociales y la crisis social y  ecológica. Esta aprobación no detendrá  las luchas socioambientales contra el saqueo del agua y la biodiversidad, por la soberanía alimentaria y la semilla, por la recuperación de tierras indígenas y en respuesta a nuevos megaproyectos de inversión en rubros de energía y minería, que generarán nuevas zonas en sacrificio.

Convocamos a trabajar articulados con las y los trabajadores, estudiantes, campesinas y campesinos, las feministas y en ámbitos como la previsión, la salud, el ambiente,  la educación y los derechos humanos, vinculando estas luchas con el llamado a la no ratificación del TPP11 y a No Más Tratados de Libre Comercio que sólo profundizan el deterioro de la calidad de vida de todos y todas. Con la primavera y octubre, veremos florecer nuevamente la esperanza.

¡NUNCA HEMOS VOTADO A FAVOR DEL TPP11!  ¡APROBAMOS RESISTIR!
