Indignados Araucanía: ¡¡¡NO AL TPP-11!!!

1. El TPP11 o Acuerdo Transpacífico De Cooperación Económica, es un tratado de libre comercio que agrupa a 11 países de la Cuenca Del Pacífico: Australia, Canadá, Japón, México, Malasia, Nueva Zelanda, Singapur, Vietnam, Brunei, Perú y Chile.

2. Originalmente incluía a EEUU, pero tras su salida, se redactó un nuevo documento muy similar al original, dejando sólo suspendidas 20 disposiciones que podrían ser reactivadas en el futuro.

3. El TPP11 es un tratado concebido y redactado con activa y vinculante participación de abogados y lobbistas que representan intereses de corporaciones transnacionales.

4. El TPP11 no se configura como un tratado de colaboración entre países, por el contrario, se presenta como un acuerdo para favorecer los negocios e intereses de las empresas multinacionales al interior de los países que lo suscriben.

5. El objetivo de este tratado es promover, facilitar y resguardar los intereses económicos de estas empresas, que buscan enriquecerse infinitamente con el mínimo de barreras legales.

6. Sus disposiciones sobre garantías a la inversión, coherencia regulatoria, obstáculos al comercio y resolución de controversias pueden ser invocadas por los inversores si los países firmantes alteran, posteriormente, las políticas, reglamentaciones y normativas legales internas de forma que afecten sus expectativas de ganancia. Esto constituye una garantía para las empresas respecto de sus horizontes de negocio.

7. Los países desarrollados que son parte de este tratado, poseen un marco legal sólido y maduro, que resguarda sus intereses sociales, económicos y ambientales. Su ventaja reside en la fortaleza de sus políticas públicas ya existentes, por lo tanto, no se verán afectadas por las restricciones que impone este tratado. Sin embargo, nuestra situación país es diferente. Nuestra reglamentación interna es permisiva, débil y embrionaria en aspectos económicos, sociales y ambientales, lo cual, es favorable para que las transnacionales puedan emprender negocios sin muchos obstáculos. Es por esta razón, que Chile resulta tan atractivo para los inversores locales y extranjeros. Luego, esta condición que impone el TPP a sus asociados, afecta radical y negativamente a nuestro país, pues inhibe la posibilidad futura para definir y aprobar disposiciones legales que busquen mejorar las condiciones en todos los ámbitos de nuestra actual situación, dado que podrían ser consideradas por las empresas como un freno o violación a sus
intereses.

8. Si de igual forma, los estados asumen cambiar o modificar sus políticas y normativas para favorecer intereses nacionales, las empresas bajo el alero del TPP11 que se sientan afectadas en sus expectativas económicas de inversión, podrán demandar a estos países en tribunales creados y concebidos, específicamente, para dar preeminencia a lo estipulado en la redacción de este tratado. Así, nuestro país se verá forzado a ajustar y restringir sus políticas, de lo contrario, deberá compensar a estas corporaciones con indemnizaciones multi millonarias.

9. Los tribunales instituidos en el contexto de este tratado tienen, al día de hoy, un marcado sesgo en resolver favorablemente las controversias en pro de los intereses corporativos y en desmedro de los estados.

10. Por lo anterior, los derechos de estas corporaciones se instalarán por sobre cualquier otro derecho, aún si éstos se conciben en pro del bienestar y desarrollo de las personas y del país.

11. En nuestro caso, este tratado debilitará la figura y función del Estado y lo someterá a ser un mero intermediario, facilitador y lobbista de los intereses capitalistas en perjuicio de los derechos e intereses de los territorios y sus habitantes. Esto ya lo hemos constatado en el marco del cumplimiento de otros tratados de libre comercio vigentes. No obstante, el TPP11 impone mayores restricciones.

12. Este tratado comprometerá y limitará las acciones que la ciudadanía está demandando en relación a la recuperación de derechos fundamentales y esenciales: Justicia y dignidad social, equidad, inclusividad, reconocimiento y respeto a los pueblos originarios, preservación y conservación del medio ambiente.

13. El TPP11 hipotecará y hará aún más difícil las posibilidades de que nuestros pueblos, comunidades y territorios puedan ejercer su derecho a recuperar el acceso al agua para concebirla como un elemento esencial para la vida, y no una mercancía con la que se especula, transa y lucra.

14. El TPP11 restringirá cualquier agenda política social, económica y ambiental en el futuro, debilitando las aspiraciones de Chile a buscar y fundar un nuevo modelo alternativo de crecimiento y desarrollo.

15. De esta forma, este tratado nos condenará a seguir siendo un país productor de materias primas y, con ello, a sostener prácticas extractivistas, contaminantes y destructivas con el medio ambiente.

16. Este acuerdo consolidará y perpetuará al capitalismo-extractivista en nuestro país como modelo económico fundado en dictadura militar, y que lleva décadas de validación y respaldo transversal de todos los gobiernos post dictadura en Chile.

17. Este tratado ya ha sido promovido, aprobado y apoyado por políticos de las bancadas opositoras y oficialistas de este gobierno y del anterior. Algunos parlamentarios lo votaron en la más absoluta e irresponsable ignorancia de los alcances nefastos que conlleva sus objetivos para el pueblo de Chile, mientras otros lo hicieron a favor, para seguir resguardando los intereses corporativos mercantilistas. No obstante, aún falta su votación por el pleno del Senado y es imprescindible que ese trámite se congele.

18. El gobierno de Piñera pretende aprobar el TPP11 antes de que se inicie el proceso constituyente, de esta forma, se asegurará de que ninguna constitución futura pueda perturbar el actual modelo neoliberal. Esto ha quedado de manifiesto con la no aprobación del Tratado de Escazú, cuyos propósitos afectarían a los objetivos que tiene el TPP11.

19. De aprobarse definitivamente, el TPP11 será un grave obstáculo para la implementación de las leyes derivadas de la nueva constitución, moderna y democrática, que el pueblo de Chile anhela para concebir y construir un país sustentado en políticas y leyes que nos permita desarrollar un modelo social equilibrado y justo, respetuoso de los intereses y derechos inalienables de las personas, de los pueblos originarios y del medio ambiente.

20. Más de 600 páginas agrupadas en 30 capítulos definen este tratado, que nos obligará a seguir siendo esclavos de un modelo económico que nos ha postergado y violentado por décadas en nuestros derechos, que ha privatizado el agua, contaminado, destruido y depredado todos los espacios naturales que definen nuestro territorio: desierto, mar, aire, bosques, glaciares, humedales, ríos y toda la biodiversidad que en ellos existe, vive y crece.

21. El TPP11 es un tratado que amenaza nuestra soberanía, legaliza y eterniza el saqueo de nuestros territorios, condenando al pueblo de Chile a renunciar a los anhelos de construir un país libre, justo, soberano y realmente democrático.
