DECLARACIÓN Y UN PROGRAMA DE ACCIÓN DE PARLAMENTARIOS Y MOVIMIENTOS SOCIALES EN OPOSICIÓN AL TRATADO TRANS-PACÍFICO (TPP)

Sobre la Declaración
Reunidos en el Diálogo Parlamentarios y Movimientos Sociales opuestos al TPP, realizado en la Ciudad de México el día 28 de enero del presente año, compartimos con la opinión pública algunas de las principales razones por las que adoptamos una firme oposición y una decidida acción para impedir su suscripción:

  1. Presentado como un modelo de tratado del Siglo XXI, el TPP fue negociado por cabilderos de las empresas trasnacionales en el más absoluto secreto, a espaldas de los ciudadanos y de los parlamentarios, que son los representantes del pueblo
  2. Los Capítulos y Anexos que integran el texto del TPP contienen disposiciones contrarias y violatorias a cualquier régimen  político  republicano,  la  pretensión  de concentrar las facultades legislativas y judiciales en instancias del poder ejecutivo y de tribunales supranacionales para dirimir controversias inversionista-Estado, violentan la soberanía de los Estados y de sus pueblos,. pues además existe la pretensión de modificar nuestras normas y régimen jurídico  nacional  conforme  los  propósitos  y exigencias del Tratado.
  3. Es contrario al principio de justicia el conceder derechos a las corporaciones que son vinculatorios para los Estados, mientras al ejercicio de los derechos humanos integrales se les ubica en la condición de cumplimiento voluntario, como reiteradamente se establece en los  textos del TPP, soslayando los  Principios Rectores  de la ONU sobre Empresas y Derechos Humanos, que da primacía a los derechos humanos por encima de las ganancias corporativas.
  4. Rechazamos dicho acuerdo porque atenta contra los derechos  humanos  laborales; salario digno, estabilidad en el empleo, educación, seguridad social, y vulnera la autentica representación laboral democrática para establecer un dialogo social. Asimismo, agudiza la concentración de la riqueza, generando más pobreza, precarización del trabajo, desempleo y desigualdad social. Además de violentar las relaciones laborales nacionales e internacionales.
  5. Como efectos inmediatos del TPP estará el inminente y grave deterioro de la salud de la población por la extensión de protección de los datos de los medicamentos, lo que tendrá como consecuencia que en los 12 países miembros los medicamentos biológicos genéricos (de más bajo costo) demoren 8 años en estar disponibles para la población, lo que implica encarecer el acceso a la salud.
  6. El TPP en general favorece la privatización de los servicios públicos a  que  tienen derecho los ciudadanos, a fin de favorecer los intereses comerciales
  7. El TPP mantiene el modelo subdesarrollado de economías, pues establece reglas y normas de política pública que impedirán cambios en la productividad de las naciones, especialmente para aquellas dependientes de las materias primas y de modelos primario exportadores.
  8. El TPP profundizará la dependencia alimentaria, la desigualdad, la pobreza, la malnutrición, el deterioro ambiental y la migración rural provocada desde antes  por  el TLCAN y las políticas gubernamentales a favor de las grandes corporaciones agroalimentarias y del modelo de la revolución verde. Representará una grave amenaza contra los derechos de los campesinos a intercambiar sus propias semillas y producir sus propios alimentos.
  9. Una vez firmado el TPP, los Parlamentos no podrán modificar sus textos y términos, pues para su ratificación, última etapa antes de que sea adoptado, los legisladores no pueden modificar una coma del texto, limitándose a su aprobación o rechazo y tampoco podrán legislar leyes nacionales contrarias a los términos del Tratado.
  10. Declaramos que la firma del TPP, el próximo 4 de febrero en Auckland, Nueva Zelanda, será en contra de la voluntad de los pueblos.

Sobre el Programa de Acción:

Recogiendo los análisis y propuestas del Diálogo entre Legisladores y Movimientos Sociales opuestos al TPP, se proponen las siguientes acciones:

  1. Campaña de difusión: nos comprometemos a desarrollar una campaña de difusión y alianza entre legisladores y movimientos sociales y civiles y ciudadanos en general de cada uno de nuestros países sobre la amenaza a la democracia y a la soberanía y de rechazo a su firma y, en su caso, su ratificación.
  2. Recursos jurídicos nacionales:  nos comprometemos a buscar de manera conjunta y coordinada la posibilidad de que en cada país presentemos la demanda de Controversia Constitucional a las disposiciones del TPP.
  3. Recursos de derechos internacional: nos comprometemos a explorar la realización de acciones ante la CIDH, para obtener su opinión sobre si el TPP es violatorio o no, de normas de Derechos Humanos y de otras normas internacionales y, en su caso, solicitar medidas cautelares ante dichas violaciones. En materia de los derechos laborales, solicitaremos consulta ante organismos de las  Naciones  Unidas  para  su  debida protección.
  4. Consulta ciudadana y popular: nos comprometemos a realizar procesos de consulta popular y ciudadana en cada uno de los países involucrados, con contenidos mínimos que garanticen transparencia  de  los  procesos y  de  la  presentación  de los  resultados obtenidos.
  5. Sobre las acciones seguidas en Estados Unidos: reconocemos la valerosa conducta y decisiva acción de los Legisladores de Estados Unidos, sensibles a las voces de protesta de muy amplios sectores y organizaciones sociales, y por consecuencia opositores a la ratificación del TPP. En consecuencia, alentamos unir esfuerzos hemisféricos e internacionales para denunciar la amenaza del TPP y exigir su entierro definitivo.
  6. Sobre las acciones seguidas en Canadá: recogemos con beneplácito la propuesta de legisladores progresistas de Canadá, opuestos al TPP, para realizar en Canadá en los meses venideros un nuevo y renovado Diálogo de Parlamentarios con Movimientos Sociales opositores y alternativos al TPP.
  7. Acciones de movilización: Convocamos a todos los movimientos sociales, civiles y ciudadanos en general  de los países involucrados a  movilizarse  para  detener   la aprobación del TPP. Las medidas de acción y movilización se iniciarán el día de la firma del TPP en Auckland, Nueva Zelandia.
