TPP: Una piedra en el camino a favor de las AFP
Como plataforma Chile Mejor sin TPP consideramos estrictamente necesario que las personas sepan las implicancias que traería la ratificación del Tratado Transpacífico de Asociación Económica ante un eventual cambio, ya sea mesurado, profundo o basado en el paradigma de la seguridad social; al actual “sistema” de pensiones.
Este TLC, impulsado por Estados Unidos para fortalecer su hegemonía geopolítica en la zona Asia-Pacífico ante la amenaza de China; en su capítulo de inversiones establece que los inversionistas extranjeros tienen una “expectativa razonable de ganancia”, la que no está sujeta a información, declaración, control ni evaluación por ninguna agencia nacional o multilateral, certeza jurídica absoluta. Esta es la relación entre la ratificación del TPP y el futuro sistema de pensiones al que aspiramos.
Además, cualquier actividad o decisión de un Estado signatario que pudiera afectar esta expectativa constituye una “interferencia pública” que podría ser causa de sanción. Conflicto que buscaría definiciones mediante un sistema de solución de controversias entre inversionistas extranjeros y el Estado receptor de la inversión a través de tribunales arbitrales al que pueden recurrir los inversionistas y empresas cada vez que consideren que alguna política estatal afecta sus expectativas. Si producto de ello un Estado es sancionado por estos tribunales, no sólo deberá pagar la indemnización que se le aplique, sino que deberá remover la causa que dio origen a esa sanción.
Es por ésto que, si el gobierno insiste en que el Congreso ratifique el TPP, no se podrá cambiar el sistema de pensiones sin que el Estado de Chile sea demandado ante un Tribunal Internacional – como el CIADI – por ejercer la justa y soberana acción en un tema tan fundamental como es tener una nuevo sistema de pensiones solidario y con aporte tripartito.
Ante esta situación, es de suma urgencia que más personas sepan lo que significaría la ratificación del TPP en un contexto donde la demanda social más fuerte y convocante, probablemente por la transversalidad del tema, es el NO+AFP. Además de que el 75% de los fondos previsionales de los chilenos, vale decir, más 120 mil millones de dólares, son controladas por empresas de Estados Unidos se encuentran ejerciendo todo tipo de presiones para impedir el cambio del sistema actual por uno solidario y de reparto.
