¡ADHIERE A CARTA PÚBLICA PARA CONGELAR EL TPP-11!

  • Requerimos una urgente reactivación de nuestra demanda NO al TPP-11 ante su muy posible puesta en tabla en el Senado para la votación final. Recordemos que fue aprobado el tratado con Brasil en plazo récord. Por ello llamamos en forma urgente a todas las organizaciones integrantes de Chile Mejor sin TLC a adherir a esta carta, y a promover su adhesión entre sus pares,  utilizando las redes sociales y el contacto directo.

Esta carta será entregada al Senado, en las sedes de Santiago y Valparaíso el día lunes 7 de septiembre.

 

 

Actuando como siempre a espaldas de la revuelta popular y sus demandas, el gobierno de Piñera, junto al ministro de Relaciones Exteriores Andrés Allamand y los gremios empresariales, pretende que el Senado dé el paso final en la tramitación del Tratado Transpacífico. Lo hace mientras los y las ciudadanos de Chile buscamos sobrevivir y reorganizarnos para  el plebiscito.  Un  poderoso “Apruebo” refrenderá este 25 de octubre la necesidad de una nueva constitución, en la mira de una Asamblea Constituyente plurinacional, feminista y popular.  Será una criatura  gestada a un año del estallido social, y su alimento fluye del caldo de cultivo de la pandemia, el hambre y la cesantía.   

El estallido social y la poderosa movilización desatada a lo largo del país generó pánico en los defensores de la constitución del 80, y en los grupos económicos responsables de lo que comprobamos dolorosamente en la pandemia: la salud pública está colapsada,  los pobres no importan,  los derechos sindicales no existen, la cuarentena es un lujo imposible para la mayoría. En muchos territorios ni siquiera hay agua para cumplir las medidas sanitarias,  los fondos de pensión no son nuestros,  el sistema escolar es pavorosamente desigual, los feminicidios crecen en pandemia, las familias deben autogestionar  su alimentación en ollas comunes y Comprando Juntos. La precariedad de la estructura social y económica de Chile desnudó el grave problema de salud en que la  pobreza es determinante.

La realización del plebiscito a través del Acuerdo por la Paz de las cúpulas políticas  fue la forma ideada por el sistema para recuperar la iniciativa. Ahora intentan por distintos medios sabotear el plebiscito. Como no pueden controlar la indignación popular ni las demandas sociales, ni disciplinarnos indefinidamente bajo la bota militar del estado de excepción, el gobierno criminal y el sistema mantienen como rehenes a más de 2.500 presos de la revuelta y a los presos mapuche. Continúa la represión y militarización en el territorio mapuche  y gozan de impunidad  los responsables de las muertes, violencia sexual, mutilaciones y traumas oculares. En la inmensa mayoría de los casos no hay formalizados ni avance en las causas.

Cuando en la Plaza Dignidad y en miles de Cabildos y Asambleas Territoriales a lo largo de Chile, exigíamos salud digna, trabajo, previsión social, y recuperación de bienes comunes como el agua y la semilla, estábamos iniciando el proceso constituyente, y definimos la necesidad de una nueva constitución construida al calor de esas demandas. Descubrimos en esas jornadas que el despojo de bienes comunes, los territorios en sacrificio, las violaciones a los derechos humanos, la militarización del territorio mapuche, el no reconocimiento de las tareas de cuidado doméstico, la violencia político-sexual y de género, y la profunda inequidad, estaban íntimamente relacionadas con el modelo neoliberal de país dependiente, minero y agroexportador, generado y fortalecido por los tratados de libre comercio. No es casual que la Ley 21.200 que habilita el plebiscito haya establecido que los tratados ya firmados deben ser respetados en el proceso constituyente y que el congreso seguirá funcionando en paralelo a la Convención Constitucional. Ellos, los dueños del poder, igual que las y los oprimidos que hemos despertado, saben que los tratados de libre comercio son una camisa de fuerza y operan como candados para bloquear las demandas populares. Por eso el gobierno pretende ahora aprobar aceleradamente el TPP-11, como un mecanismo final que haga impracticables los acuerdos adoptados al calor del proceso constituyente. Están instalando esta bomba de tiempo contra la voluntad popular.

El poder constituyente debe ser originario y reside en  el pueblo soberano. Acelerar ahora  la tramitación  del TPP-11 con el mecanismo de urgencia suma por parte del gobierno, que confía en la “disciplina” de la mesa del Senado para votarlo, es a nuestro juicio una provocación intolerable, es usurpación del poder constituyente y una prueba de fuego para los senadores. 

El gobierno, con un desempeño en pandemia que supera ya los 15.505 fallecidos como consecuencia de una gestión que ha puesto los negocios por encima de nuestra salud,  está en su más bajo nivel de apoyo. Los senadores no representan ninguna oposición real. Se han limitado a sacar adelante la agenda de Piñera para reprimir a quienes desafíen la cuarentena para llevar comida a su casa mientras avanza el proyecto de  Ley de Inteligencia,  consumando  una operación progresiva de pinza y control de los movimientos sociales. Jamás legislaron en dirección a contar con una  renta básica universal, ni aumentar la tributación a los ricos. 

La ley del retiro del 10% no es atribuible sólo a la oposición parlamentaria. Fue más bien la respuesta ineludible a la inmensa presión de un pueblo asfixiado que no veía señales concretas para salir del estado de necesidad profundizado por el Covid-19.  Piñera ha entregado migajas selectivas ante las dramáticas condiciones imperantes, mientras en los territorios, los esfuerzos locales han estado volcados a responder a  la crisis, recibir atención hospitalaria, y/o gestionar ollas comunes y redes locales de abastecimiento. Avanzan también medidas regulatorias favorables al modelo extractivista, que multiplicarían la destrucción de territorios por obra de la minería, el agronegocio, las empresas  inmobiliarias, energéticas y los monocultivos forestales. 

Recordatorio

El TPP-11 es un tratado de segunda generación que cuenta con mecanismos de resolución de controversias por fuera de los tribunales nacionales, de manera de garantizar la inversión de las corporaciones transnacionales ligadas en Chile al negocio de las  AFP, a la minería,  el agronegocio, las farmacéuticas, la energía, la educación, entre otros. La amenaza de posibles demandas internacionales contra el Estado, puede operar como freno para la adopción de medidas que vayan en dirección de terminar con las AFP, -donde hay inversión de trasnacionales-  o de recuperar la salud pública y permitir por ejemplo que Chile vuelva a producir vacunas y pueda generar dispositivos e insumos médicos de alta complejidad, afectando los intereses de las farmaceúticas por las patentes.

En la pandemia el gobierno se negó a liberar los servicios básicos de todos y todas previendo sin duda posibles demandas. Pero la nueva Constitución soberana debe asegurar el derecho humano al agua de todos y todas, incluidos entre ellos, los derechos de los despojados del agua por los monocultivos del agronegocio y las forestales, o por la contaminación de la megaminería. Sin embargo, según el TPP11, legislar para que vuelva la vida a los territorios saqueados, reparar al pueblo mapuche y legislar para la recuperación de sus tierras hoy en manos de las forestales, puede ser considerado una expropiación y significar también demandas internacionales al Estado ante estos tribunales.  Recordamos que Canadá, miembro del TPP-11 concentra las mayores inversiones mineras en Chile. 

Éste es un elemento central, puesto que estudios realizados por centros de estudios como el TNI (Transnational Institute) anticipan que las políticas implementadas por los gobiernos para enfrentar la pandemia, traerán como consecuencia un incremento significativo de demandas contra los Estados, invocando derechos adquiridos durante la firma de acuerdos comerciales. Ésa es la confrontación: estos tratados no están hechos para favorecer a la población, sino a las corporaciones.

Concretamente, la entrada en vigencia del TPP podría haber impedido medidas como las tomadas recientemente en Chile ante la crisis social. El profesor de la Universidad de Cambridge, José Gabriel Palma, señaló que acciones como el retiro del 10 por ciento de los ahorros previsionales o la implementación de créditos blandos podrían haber sido objeto de demandas multimillonarias por parte de las AFPs y la Banca, respectivamente, por afectar los intereses que el TPP consagra a las multinacionales.

Vamos a generar una nueva constitución en medio de una crisis ecológica planetaria sin precedentes, agudizada por una pandemia global cuyo origen está relacionado con la explotación intensiva de la naturaleza. Por eso, repensar nuestra relación con la naturaleza, para caminar hacia un mejor vivir, y recoger las demandas de los pueblos indígenas derivadas de sus derechos y de su propia cosmovisión ligada a la naturaleza,  se nos aparece como  ineludible

Al Senado de Chile

En julio de 2018 ejercimos democracia directa realizando un plebiscito en el que millones de chilenas y chilenos votamos NO AL TPP-11.  A partir del 18 de octubre esos resultados fueron asumidos por el pueblo movilizado, y quedaron escritos en los muros y pancartas en todo Chile.

Por todo esto, ejercemos desde ya nuestros derechos, asumidos por la revuelta popular, refrendados en los Cabildos y asambleas territoriales a lo largo del  proceso constituyente. Como parte organizada del pueblo de Chile y sus expresiones sociales, exigimos a la presidenta del  Senado de Chile, Adriana Muñoz y a las y los senadores, no dar cabida a la inclusión  del TPP-11  en la tabla del Senado, por respeto a la voluntad popular.

Observaremos sus decisiones y actuación y no las olvidaremos.  El TPP-11 debe salir definitivamente de la agenda legislativa, eliminando esa usurpación contra el poder constituyente del pueblo y permitiendo el libre desarrollo del plebiscito y el proceso que se abra a partir de ello.
