PLAGUICIDAS CANCERÍGENOS INCLUIDOS EN EL ACUERDO COMERCIAL CHILE-BRASIL (PIÑERA-BOLSONARO)

El Acuerdo de Libre Comercio (ALC) entre Chile y Brasil se enmarca en la misma estrategia de crecimiento cuyos dañinos resultados en salud pública y dependencia alimentaria se han hecho más evidentes en la crisis sanitaria.  Refuerza el poder de las agroquímicas productoras de plaguicidas altamente peligrosos como  Bayer/Monsanto, que fabrica en Brasil genéricos como el  cancerígeno herbicida glifosato y lo exporta a Chile, y con este acuerdo tendrá un nuevo mecanismo para objetar cualquier medida que Chile adopte en esta materia para resguardar la salud de la población.  Este acuerdo comercial  forma parte del engranaje  compuesto por el lobby de las corporaciones transnacionales agroquímicas, las disposiciones del Mercosur, de la Organización Mundial del Comercio (OMC) y del Comité de Medidas Sanitarias y Fitosanitarias (Comité MSF). EL MSF busca asegurar que medidas públicas de ese tipo adoptadas no constituyan obstáculos al comercio. 

Este Acuerdo fue generado por los negociadores de siempre, anquilosados en la DIRECON. Suscrito por Roberto Ampuero en su breve paso por Cancillería,  fue aprobado por el Senado en pandemia,  sin debate, participación, ni  estudios de impactos sociales, ambientales o económicos.  Se publicita como un tratado donde ambas naciones “desean promover altos niveles de protección ambiental”. Pero Piñera en vez de firmar el Acuerdo de Escazú, se apresura a acordar  un tratado con un país cuyo presidente denunciado internacionalmente  por  la devastación de la Amazonía y los pueblos indígenas, el trabajo precario y las violaciones de derechos humanos a la salud y a la alimentación sana.

Con Bolsonaro,  el comercio de plaguicidas altamente peligrosos está llegando a niveles críticos. En Chile, la situación no es mejor, con normas sobre plaguicidas laxas e insuficientes. Desde hace décadas los habitantes rurales, los campesinxs, las asalariadas agrícolas y sus hijas e hijos sufren recurrentes intoxicaciones agudas y una serie de graves enfermedades, como cáncer, asociadas al uso masivo e indiscriminado de plaguicidas altamente peligrosos.

Brasil, el mayor importador de agrotóxicos del mundo 

En agosto de 2019 el gobierno de Bolsonaro, publicó en el Boletín Oficial el marco regulatorio exprés para plaguicidas. Omitió así la tramitación parlamentaria del Proyecto de Ley 6299/02 que por sus contenidos había sido llamada por sus detractores la Ley do Veneno. La medida fue Considerada una vergüenza por expertos en salud pública, ya que deja a la población más vulnerable a enfermedades asociadas a plaguicidas, al eliminar requisitos básicos para su registro, con el pretexto de que son «científicamente innecesarios» para la toma de decisiones regulatorias. 

La regulación del otorgamiento recíproco de preferencias arancelarias y de normas sobre facilitación del comercio entre Chile y Brasil, orientada a establecer modalidades para hacer más expeditas las operaciones de importación y exportación entre las partes, se da en este marco de flexibilización de los criterios de evaluación y clasificación de plaguicidas altamente peligrosos y de una baja total de los estándares normativos en Brasil.

Si bien en los últimos años el crecimiento de plaguicidas peligrosos registrados en Brasil es preocupante1, en lo que va de año 2020 la cifra se ha disparado con la autorización de 241 plaguicidas, según registros publicados en el Boletín Oficial de Brasil,  un récord en la serie histórica. Recientemente, el 10 de agosto de 2020, el Ministerio de Agricultura de Brasil autorizó el registro de un nuevo ingrediente activo y cinco genéricos para la formulación de plaguicidas agrícolas. La alarma se ha centrado en el herbicida piroxasulfone, prohibido en la Unión Europea;  en el insecticida genérico dinotefuran, considerado «extremadamente tóxico» para uso industrial por la Agencia Nacional de Vigilancia Sanitaria (Anvisa,  del propio Ministerio de Agricultura),  y el plaguicida altamente peligroso acefato, prohibido en la Unión Europea y uno de los más vendidos en Brasil. Acefato es posible carcinógeno humano (EPA); disruptor endocrino y del sistema reproductivo, fetotóxico; genotóxico (aberraciones cromosómicas), y sus residuos causan la muerte de abejas, de aves y especies marinas.

El aumento en el registro de plaguicidas en Brasil se da precisamente en los plaguicidas llamados ‘genéricos’. De los 169 plaguicidas registrados en 2019, ninguno es nuevo y más de la mitad (52%) son copias de ingredientes activos previamente aprobados. De ellos, 48% se clasifica como alto o extremadamente tóxico. Agrava esta situación, el hecho de que el 25% de los productos aprobados por el gobierno en 2019 no están permitidos en la Unión Europea2 . Respecto de los derechos laborales, en este caso de quienes trabajan en el campo expuestos a estos productos, el tratado sólo establece los derechos mínimos aprobados por la OIT, tal como hace el TPP11, sin garantizar el verdadero resguardo de los derechos de lxs trabajadores rurales y de otros rubros. 

Libre tráfico de venenos con beneficio arancelario Mercosur

Pero Brasil no solo se ha convertido de forma creciente en el depósito de plaguicidas prohibidos en otros países, sino también es el gran exportador de plaguicidas peligrosos a Chile.  De 103 principios activos de la categoría de plaguicidas altamente peligrosos (PAP) registrados en Chile, 29 (28%) de ellos se importan desde Brasil. Y 11 (37,9 %) de los principios activos plaguicidas PAP importados desde Brasil, están prohibidos en la Unión Europea. Entre ellos, acefato, cancerígeno (fabricado por Arysta Lifesciences do Brasil), acetoclor, perturbador endocrino, Categoría 2 Carcinógeno del Sistema Global Armonizado, SGA (fabricado por Monsanto do Brasil), atrazina, altamente peligroso,  perturbador endocrino, Categoría 2 Carcinógeno del Sistema Global Armonizado (fabricado por Syngenta Protecao de Cultivos), cadusafós, altamente tóxico y contaminante ambiental (fabricado por FNC Química Do Brasil S.A), carbofurano, fatal si se inhala y muy tóxico en abejas (fabricado por  FNC Química Do Brasil S.A), flocoumafén (BASF PLC). 

Glifosato,  un herbicida con prontuario

Brasil exporta a Chile glifosato, plaguicida altamente peligroso clasificado como posible cancerígeno en humanos por la Agencia Internacional de Investigaciones del Cáncer, IARC, de la Organización Mundial de la Salud. Este herbicida está asociado al menos a  un tipo de cáncer lo que ha generado decenas de miles de juicios en Estados Unidos. Bayer/Monsanto deberá pagar hasta 10.900 millones de dólares en un acuerdo masivo con 125.000 demandantes estadounidenses, un 75% del total de demandantes que sufren de cáncer debido a la exposición al herbicida Roundup, fabricado por Monsanto. 

El glifosato es exportado a Chile por varios fabricantes de Brasil, entre ellos, Monsanto Company, Pilarquin Br Comercial Ltda., Nurfarm Industria Química e Farmaceutica S.A, Syngenta Protecao de Cultivos Ltda, Syngenta S.A. En Brasil, con grandes extensiones de cultivos transgénicos de maíz y soya tolerantes al glifosato,  existe preocupación entre salubristas y ambientalistas debido a que, de todos los plaguicidas aprobados en 2019 en Brasil, 8 son moléculas o mezclas de glifosato. El problema es que cuando se solicita el registro de un plaguicida denominado genérico no es necesario presentar estudios toxicológicos, ni caracterizar el producto para evaluación de impacto ambiental, ni probar su eficacia, si con anterioridad se registró un plaguicida con las mismas características y usos.

La fuerte relación entre el lobby de la agroindustria y las decisiones de la Agencia de Vigilancia Sanitaria, Anvisa, le permitió no sólo lograr la extensión en Brasil  del uso de un número importante de plaguicidas peligrosos prohibidos en otros países sino   defender la permanencia en ese registro, de plaguicidas altamente cuestionados o prohibidos por sus daños a la salud y el ambiente en diferentes países. Es el caso del herbicida paraquat,  un plaguicida altamente peligroso prohibido en la Unión Europea y asociado a la enfermedad de Parkinson, entre otras. Actualmente, el lobby de la agroindustria en el Congreso y en ANVISA está enfocado en revertir una decisión anterior de ANVISA que prohíbe, a partir del 22 de septiembre de 2020, la comercialización de paraquat. 

Por otra parte, en Brasil desde 2015 están autorizados los eucaliptus transgénicos manipulados genéticamente en ese país. Ello abre una nueva palanca en pro  de la legalización de los cultivos transgénicos en Chile.  El capítulo sobre Biotecnología Agrícola del tratado, pide “evitar autorizaciones asincrónicas de organismos genéticamente modificados”, sin explicar sus alcances. En Brasil este año ya comenzará a comercializarse el poroto carioca transgénico. Además, en el capítulo sobre Comercio y Biodiversidad, el tratado contempla artículos sobre el “acceso a los recursos genéticos”, entre los cuales están las semillas nativas,  de interés para los investigadores de la industria semillera y productora de agrotóxicos, entre ellos Bayer/Monsanto. Chile es centro de origen del poroto, por lo cual la llegada del poroto transgénico constituiría una fuerte amenaza para la biodiversidad.

En síntesis, este tratado de libre comercio empeora la situación de los trabajadores respecto de su salud y derechos, favoreciendo los intereses de las corporaciones trasnacionales.
