Razones para rechazar el TPP-11: Derechos y leyes laborales

Las organizaciones que conformamos la Plataforma Chile Mejor Sin TLCs hemos entregado numerosas minutas a diversas instancias del parlamento cubriendo un gran número de aspectos relacionados con la soberanía nacional, la salud y los medicamentos, la protección de los derechos humanos y de los pueblos originarios, la protección de los derechos de los trabajadores, la protección del medio ambiente, la protección de las empresas estatales como CODELCO, la agricultura y la alimentación, las semillas y, en general, el respeto a normas democráticas fundamentales. Estas razones hacen innegable la necesidad de rechazar el CPTPP y hacen extremadamente peligroso que el gobierno de Chile busque hoy aprobar un tratado de tan nefastas consecuencias mediante la vía rápida y sin permitir una discusión seria y responsable.

El CPTPP restringe severamente la definición de los derechos laborales y abre la puerta para que en el futuro se eliminen derechos laborales fundamentales reconocidos por la actual legislación chilena.

Mediante el Artículo 19.1 el CPTPP hace la siguiente definición de las LEYES laborales:

Leyes laborales significa las leyes y regulaciones, o disposiciones de las leyes y regulaciones, de una Parte que están directamente relacionadas con los siguientes derechos laborales internacionalmente reconocidos:
(a) la libertad de asociación y el reconocimiento efectivo del derecho a la negociación colectiva;
(b) la eliminación de todas las formas de trabajo forzoso u obligatorio;
(c) la abolición efectiva del trabajo infantil, la prohibición de las peores formas de trabajo infantil y otras protecciones laborales para niños y menores;
(d) la eliminación de la discriminación en materia de empleo y ocupación; y
(e) condiciones aceptables de trabajo respecto a salarios mínimos, horas de trabajo, y seguridad y salud en el trabajo;

Mediante el Artículo 19.3 se hace exactamente la misma definición de los DERECHOS laborales
Artículo 19.3: Derechos Laborales

1. Cada Parte adoptará y mantendrá en sus leyes y regulaciones, y en las prácticas que deriven de éstas, los siguientes derechos tal y como se establecen en la Declaración de la OIT:

(a) libertad de asociación y el reconocimiento efectivo del derecho a la negociación colectiva;
(b) la eliminación de todas las formas de trabajo forzoso u obligatorio;
(c) la abolición efectiva del trabajo infantil y, para los efectos de este Tratado, la prohibición de las peores formas de trabajo infantil; y
(d) la eliminación de la discriminación en materia de empleo y ocupación.

2. Cada Parte adoptará y mantendrá leyes y regulaciones, y prácticas que deriven de éstas, que regulen condiciones aceptables de trabajo respecto a salarios mínimos, horas de trabajo, y seguridad y salud en el trabajo.

Con estas definiciones, el CPTPP acepta lo arriba indicado y SÓLO LO ARRIBA INDICADO como leyes y derechos laborales, imponiendo una definición estrecha y retrógrada de ellos. De esta forma, para el CPTPP no son derechos ni leyes laborales la huelga, el derecho a contrato, el derecho a indemnización, el derecho al descanso y vacaciones pagadas, el derecho a jubilación, a un sistema de seguro de salud, a permiso pre y post natal, a no ser despedida por embarazo, a amamantar, a protección contra el acoso laboral y otras que no se deriven directamente de los cinco puntos que se aceptan.

El gobierno y la Direcon ha argumentado que lo que el CPTPP incluye corresponde a “altos estándares laborales”, aseveración absolutamente falsa. Los derechos laborales definidos por el CPTPP son los mismos definidos como derechos básicos y universales por la “Declaración de la OIT relativa a los principios y derechos fundamentales en el Trabajo”de 1998 . Según la OIT, esta declaración “compromete a los Estados Miembros a respetar y promover los principios y derechos comprendidos en las cuatro categorías, hayan o no ratificado los convenios pertinentes”. Desde 1998, Chile ha ratificado los Convenios 87, 98, 105, 138 y 182 de la OIT para la implementación de esta Declaración. Por lo mismo, en el mejor de los casos, el Capítulo 29 del CPTPP nos dejaría con una suma cero en relación a derechos laborales.

Pero la situación es en realidad mucho peor. De acuerdo al capítulo 27 del CPTPP, éste deberá ser renegociado en forma periódica con el fin explícito de aumentar las garantías al capital extranjero. De aquí deriva que, mediante las renegociaciones periódicas, Chile podrá ser presionado, para que elimine todos los derechos laborales actualmente reconocidos en su legislación que no están incluidos en la definición del CPTPP y si no lo hace o exige a una empresa transnacional que respete algunos de los derechos que el tratado no reconoce, podrá ser llevado a litigio internacional.

El gobierno ha indicado que esto es en realidad “un piso” y que no excluye otros derechos. Nuevamente esto es falso. La definición incluida en el CPTPP es concisa y precisa y en ningún caso indica que otros derechos laborales serán considerados como tales. Cada vez que el CPTPP incluye algún articulado que ha de ser considerado como un piso, se incluye la expresión “al menos”. Por ejemplo, el Capítulo 18 sobre Propiedad Intelectual incluye 27 “al menos”, el Capítulo 2 sobre Acceso (comercio) de Mercancías incluye 8, el de Inversiones incluye 3. Indicativamente, el capítulo 19 sobre derechos laborales no incluye ningún “al menos”.

Queremos indicar que lo que aquí concluimos de la lectura del Capítulo 19 del CPTPP coincide con la conclusión alcanzada por el gobierno de Argentina, que en el texto sobre derechos laborales del TLC Chile-Argentina, mediante los Artículos 12.1 y 12.4, exigió -por presión de las organizaciones sindicales argentinas- que se incluyese además de lo incluido en el CPTPP el derecho al descanso y a vacaciones pagadas, el derecho al post natal, el derecho a jubilación (seguridad social), y la protección contra el desempleo.

Por último, una de las razones esgrimidas por el gobierno para defender el CPTPP es que éste permitiría mayores exportaciones y así generaría mayores y mejores empleos. Si tomamos como referencia los empleos generados por el llamado milagro agro-exportador, el aumento de las exportaciones debiera tomarse como un llamado más a la preocupación en torno al tratado, y no como una posible justificación. Las exportaciones agrícolas han aumentado más desde 7 veces desde fines de la década de 1980, pero la cantidad de empleos generados por la agricultura se ha mantenido estacionaria desde esas mismas fechas (Fuente: ODEPA). Esto indica que la agroexportación no generó nuevos empleos, sino que destruyó y reemplazó empleos. Los empleos eliminados provienen principalmente de la pequeña y mediana agricultura dedicada a la producción de alimentos para el consumo nacional, que se vio arruinada producto de las importaciones que invadieron el país a partir de la firma de otros TLCs. Lo que jamás menciona el gobierno, es que el CPTPP no sólo permitirá más importaciones, sino que facilitará especialmente más importaciones, poniendo en peligro la sobrevivencia de mucha micro, pequeña y mediana empresa, principales generadores de empleo.

Si tomamos nuevamente la experiencia acumulada por la agroexportación, el peligro anterior se ve agravado. Los empleos generados por la agroexportaciónhan sido de mala calidad, inestables, precarios y mal pagados. De acuerdo a cifras publicadas por ODEPA en noviembre de 2018 , sólo el 21% de los trabajadores de la fruta y menos del 5% de las trabajadoras del mismo sector tienen trabajo estable. En otra publicación de ODEPA, indica que “En 2015, el salario promedio de los ocupados de la economía fue 1,58 veces más alto que el del sector agrícola” La situación de las trabajadoras es aún peor ya que en promedio ganan el 40% que el promedio nacional de los hombres. La promesa de “más y mejores empleos” no tiene correspondencia con la realidad concreta que hemos experimentado hasta el momento.

Por todo lo anterior, solicitamos a la Comisión de Trabajo y Seguridad Social de la Cámara de Diputados y a todas y todos los diputados que rechacen el CPTPP.
