Viejas y nuevas tendencias en los Tratados de Libre Comercio

Desde hace 25 años se han negociado y firmado más de 300 Tratados de Libre Comercio (TLC) y cerca de 3.000 Tratados Bilaterales de Inversión (TBI) a nivel global. En este cuarto de siglo, estos tratados han ido ampliando los derechos para inversores y operadores de comercio, mientras acotan el margen de maniobra de los Estados. Podemos establecer que el Tratado de Libre Comercio de América del Norte (TLCAN o NAFTA por su sigla en inglés) fue el primer gran TLC (tanto global como regional) que implicó la incorporación de los llamados temas “detrás de las fronteras” como servicios, inversiones, telecomunicaciones, compras públicas, entre otros. Este primer gran tratado ya incluía fuertes obligaciones para los tres países mediante la inclusión del mecanismo de solución de controversias inversor-Estado, que permite a los inversores demandar a los países en tribunales arbitrales internacionales en caso de que una política pública afecte su inversión de cualquier modo.

A nivel continental, las cláusulas del TLCAN fueron luego profundizadas por el Área de Libre Comercio de las Américas (ALCA). Aunque nunca fue firmado, el ALCA logró un importante avance en las negociaciones. A partir del tercer borrador del ALCA se hace visible una profundización de los derechos corporativos con respecto al tratado de América del Norte, especialmente en capítulos como Propiedad Intelectual e Inversiones. Más recientemente, un tercer piso lo constituye el Tratado Transpacífico (TPP). Este tratado fue presentado por Hillary Clinton, entonces Secretaria de Estado, como el nuevo gold standard, el estándar de oro, para todas las negociaciones comerciales norteamericanas. El TPP es de hecho el tratado más avanzado con respecto a los derechos que se otorga a las grandes corporaciones. Cuando Donald Trump retiró a EEUU del acuerdo en enero de 2017, los 11 países restantes renegociaron el acuerdo y lo presentaron como “progresivo”. Pero en realidad implica que un número pequeño de cláusulas fueron “suspendidas”, no retiradas del tratado, por lo cual si EEUU volviera a sumarse en un futuro cercano, esas cláusulas del actual TPP-11 podrían ser re-activadas.

Actualmente la guerra comercial entre EEUU y China presenta un escenario incierto para muchas de las negociaciones comerciales a nivel global. La proliferación de TLC y TBI de los últimos 25 años estuvo enmarcada en el auge de las instituciones globales neoliberales y de una arquitectura jurídica internacional que marcó la constitución de una gobernanza del comercio a favor de la libre circulación del capital y de las mercancías. No estamos necesariamente viendo un retroceso de ese proceso de internacionalización del capital, pero sí observamos la crisis en los organismos de esta particular gobernanza. Especialmente, la Organización Mundial del Comercio está en crisis desde el 2003, expresando que la institucionalidad neoliberal no tuvo totalmente allanado el camino para marcar reglas de juego estables y duraderas a favor del capital.

Los efectos negativos de los tratados han empujado una discusión sobre los modelos de negociación para los TLC y los TBI. Diversos países han empujado la revisión de los estándares otorgados a los inversores extranjeros (Sudáfrica, Noruega, Indonesia), impulsando la firma de tratados con nuevos modelos (Brasil, Bolivia), saliendo de instituciones arbitrales como el Centro Internacional de Arreglo de Diferencias sobre Inversiones (CIADI) (Ecuador, Venezuela, Bolivia), o frenando el avance de nuevas negociaciones multilaterales como la Facilitación de Inversiones (India, Sudáfrica, Uganda, Camerún).

¿Y América Latina? Varios de los países latinoamericanos parecen haber encontrado su camino en la incertidumbre. Pero ese camino implica blindar jurídicamente la reprimarización de las economías de la región. Esto se realiza mediante la firma de nuevos TLC bajo el pretexto de que garantizan la inversión extranjera. Estos TLC son con terceros países, como los del Sudeste asiático, pero también intrarregionales, en un avance de la convergencia entre los dos principales bloques económicos de la región: el Mercosur y la Alianza del Pacífico. La firma de nuevos TLC bilaterales entre ambos bloques avanza para generar una “gran zona de libre comercio en América Latina”. Chile ha tenido un rol activo firmando TLC con Uruguay y Argentina, y cerrando la negociación con Brasil. Por su parte, Argentina firmó en 2018 un Acuerdo de Complementariedad Económica (ACE) con Colombia para liberalizar el comercio bilateral.

Estos TLC intrarregionales han sido presentados como nuevos “marcos regulatorios”, inocuos y sin peligros, ya que simplemente profundizan y extienden el marco jurídico bilateral del espacio económico ya regulado por los ACE de los años noventa en el marco de la Asociación Latinoamericana de Integración (ALADI). Efectivamente, se trata de TLC que no modifican la sustancia del comercio entre los países de la región, porque el comercio ya está casi completamente liberalizado. Esto muestra que los TLC tratan sobre mucho más que aranceles y tarifas. Son tratados que avanzan en la desregulación y liberalización de amplias actividades económicas que en las últimas décadas han estado en mano de los Estados.

Entonces, al igual que el ALCA hace más de 10 años, los nuevos TLC son la herramienta legal de las fuerzas que empujan por la apertura económica en la región. Esto se realiza a través de los llamados “temas regulatorios” con la incorporación del mecanismo de Coherencia Regulatoria y las “buenas prácticas regulatorias”, que se han insertado dentro de los capítulos de Facilitación del Comercio y Obstáculos Técnicos al Comercio de estos TLC. La Coherencia Regulatoria implica la tendencia a la homogeneización de las legislaciones y regulaciones internas, así como el diálogo con el sector privado. Este mismo mecanismo fue incorporado en el “tercer piso” de los TLC que mencionamos anteriormente (TPP y TTIP).

La inclusión de todos estos temas ha sido fuertemente criticada por la sociedad civil, justamente porque implica privilegios de propiedad para las empresas transnacionales y los inversores extranjeros, cuyos derechos se convierten en el nuevo estándar para la legislación, mientras se socava la posibilidad de aplicación de los derechos humanos. De hecho, los países latinoamericanos fueron demandados en tribunales arbitrales cerca de 800 veces(1), mostrando los efectos que estos 25 años de TLC y TBI han tenido sobre los países de la región.
