Declaración pública: ASAMBLEA CONSTITUYENTE AHORA Y SIN TPP-11

Teniendo como referente el pueblo movilizado en las calles, cuyo estallido social se inició luego de que RED subiera el precio del pasaje del metro unilateralmente y sin considerar las consecuencias para la ciudadanía, modo de proceder que se ha repetido durante años en la vida nacional, exigimos que gobierno y congreso avancen ya  a posibilitar la Asamblea Constituyente y no traicionen la demanda social central surgida de los cabildos y asambleas autoconvocadas. Esa es la única salida a la crisis, tal como postula los y las millones de mujeres, hombres, y jóvenes que sostienen en todo el país la demanda de cambiarlo todo, asumida también por Unidad Social. Además, como Plataforma Chile Mejor sin TLC puntualizamos que en forma paralela, debe retirarse formalmente de trámite en el Congreso el Tratado Transpacífico TPP-11 puesto que ese tratado constituye un blindaje, una suerte de bomba de tiempo programada para impedir los cambios.

Mantener el TPP en tramitación significa que cuando Piñera y el Senado  así lo estimen, pueden avanzar y dar el último paso restante: la votación del pleno del senado. Una eventual aprobación del TPP-11 podría utilizarse por la clase política refractaria a los cambios, como un seguro previo contra los resultados de la Asamblea Constituyente que desde ya son resistidos por los parlamentarios defensores del modelo neoliberal y sus reaseguros instaurados por la constitución del 80. En la previa del 18 de octubre, las comisiones del Senado terminaron de despachar el TPP con una abrumadora aprobación,  por lo cual no existe ninguna garantía de su rechazo.

La salida a la crisis tiene que garantizar una Asamblea Constituyente que pueda responder a las demandas sociales desprivatizando lo que la constitución redactada por Jaime Guzmán convirtió en mercancía: la educación, la salud, la previsión social, y los bienes comunes como el agua, la semilla. La actual constitución subsidia en cambio, el extractivismo minero, forestal y de la agroindustria. Desprivatizar es recuperar derechos sociales y económicos, es buscar otra relación con la tierra y la  naturaleza, y ello está directamente relacionado con el TPP-11 porque justamente ese tratado contiene mecanismos que consideran como “expropiación” toda ley o política pública que al cambiarles las reglas del juego a las grandes corporaciones transnacionales mineras, energéticas afecte sus intereses. El TPP prohíbe asimismo condicionar la inversión a la transferencia de tecnología. Las transnacionales nos condenan con el TPP-11 a seguir siendo un país sin desarrollo tecnológico,  exportador de bienes sin valor agregado, y con laxas leyes ambientales y sociales porque tendrán capacidad de vetarlas debido a la llamada “coherencia regulatoria”.

Las leyes laborales actuales, herencia de la dictadura, serán sin duda barridas por la asamblea constituyente, para que los y las trabajadoras puedan recuperar también sus derechos conculcados, derechos reclamados hoy en el gran paro nacional del pasado 12 de noviembre. Pero  todos los logros futuros de esta lucha en la que nos inclinamos y lloramos por nuestr@s muert@s, herid@s, lesionad@s, violad@s y torturad@s, pueden ser dramáticamente revertidos con el TPP-11.  Chile del mañana será demandado en tribunales internacionales donde no contaremos con las garantías del debido proceso, y el Estado deberá pagar millonarios costos cuando hagamos efectiva la recuperación concreta de nuestros derechos a través de nueva constitución plasmada por la vía de la Asamblea Constituyente.   

Reafirmamos entonces que la salida a la crisis requiere de una Asamblea Constituyente sin TPP-11, es decir que desde ya debe eliminarse esa trampa. Sostenemos que es inaceptable que personeros de la UDI y Renovación Nacional, defensores del TPP-11,  pretendan que se ponga a votación en el plebiscito la alternativa de convención constituyente que les asegura quitarle la voz directa al pueblo y mantener su injerencia en nuestro futuro.  Todos ellos, y también algunos integrantes de la oposición carecen de legitimidad ya que legislan de acuerdo a los intereses de quienes han financiado sus campañas y permanentemente han saboteado todos los intentos de legislar para favorecer a las grandes mayorías en temas como educación, salud, aborto, etc. Ellos claramente forman parte del problema y no de la solución. Entre los senadores, dos han sido tres veces reelectos (Jorge Pizarro, DC y García Ruminot RN). El diputado UDI Patricio Melero lleva 29 años en el cargo, al igual que el diputado DC José Miguel Ortiz y son el rostro más claro del desprestigio de la política, claramente rechazados por la ciudadanía.
