Crímenes contra los DD.HH. y renegociación del TLC Chile-Unión Europea
Como Plataforma Chile Mejor sin TLC, hacemos un llamado al Consejo de Estados Miembros de la Unión Europea; a su órgano ejecutivo, la Comisión, y al Parlamento Europeo que representa a los ciudadanos y ciudadanas, a hacer valer el respeto a los DDHH y detener inmediatamente la negociación de la modernización del Acuerdo de Asociación entre la Unión Europea y Chile en vigor desde 2003, solicitada en La Moneda el pasado 4 de marzo por el Presidente Piñera a los embajadores de la UE en Chile . En esa conversación se ignoró el macizo reporte de la delegación del Parlamento europeo que visitó Chile en octubre de 2019 elaborado a partir de la información recogida en intensas reuniones con representantes de organizaciones de ddhh, y organizaciones sociales y políticas en Santiago y Valparaíso. La sexta reunión de las partes se realizó en noviembre de 2019, sin importar el estallido social. A la fecha de la reunión de marzo, ya eran públicos los informes de Amnistía Internacional, Human Rights Watch, ACNUDH, y del Instituto Nacional de DDHH, acerca de las ininterrumpidas y gravísimas violaciones a los derechos humanos en curso. Los asesores ocultaron otro dato relevante: hoy los tratados de libre comercio son ampliamente cuestionados por las y los movilizados en la revuelta popular, dada la inexistencia de una evaluación integral de sus impactos y su carácter de pilar del modelo neoliberal impuesto por la constitución pinochetista que aún rige Chile. Como ejemplo, citamos la campaña virtual en curso «Chile, ¿Agua o Aguacates?» sobre los costos de la agroexportación. La campaña es global y pide firmar por la derogación del Código de Aguas (1981), la restricción al cultivo de paltas y acceso al agua potable y de riego para las comunidades de Petorca, Chile.
Violación sistemática de los DDHH
La Fiscalía Nacional registraba a fines de enero 31 muertos en el contexto de protestas. Los últimos meses la cifra de muertos ha seguido aumentando. El informe oficial dado a conocer por el Instituto Nacional de DDHH para el período comprendido entre el 18 de octubre de 2019 y el 18 de febrero de 2020, reporta un total de 3.765 personas heridas (entre ellas 439 mujeres y 282 niños, niñas y adolescentes)y 411 traumas oculares. De las 2.122 heridas por disparos, 500 fueron por balas, 190 por balines, 271 por bombas lacrimógenas, 1.681 por perdigones y 200 sin causa identificada. El INDH ha presentado 1.312 acciones judiciales con escaso avance, entre ellas 5 por los homicidios cometidos por agentes del Estado;195 querellas por violencia sexual (violaciones, entre otros abusos) y 951 por torturas. La Coordinadora por la Libertad de las y los Presos Políticos de la revuelta, cifra en más de 2000 los detenidos, muchos de ellos menores de edad.
El proceso de renegociación del Tratado con la UE se inició en noviembre de 2017, con la habitual falta de transparencia. Los negociadores de la Unión Europea abocados a la tarea, no pueden alegar hoy desconocimiento de la crisis de derechos humanos que se vive en Chile. Tras conocer el completo informe elaborado por la delegación del Parlamento Europeo que visitó Chile en octubre en pleno estado de emergencia y con los militares en la calle, 40 diputados de la entidad dirigieron una carta a la entonces Alta Representante de la Unión para Asuntos Exteriores, Federica Mogherini (cuyo puesto ocupa hoy Joseph Borrell), solicitándole entre otras medidas, “que en el marco del diálogo político, la UE …solicite una reunión urgente con la Embajada de Chile ante la UE…y haga valer la cláusula de democracia del Acuerdo de Asociación que mantiene la Unión con Chile (Acuerdo de Asociación Económica, AAE), donde se establece el respeto de los derechos humanos fundamentales, el desarrollo económico y social sostenible; y compromete además a las partes con la buena gobernanza.” Demandaron asimismo los diputados que, de no haber cambios en la situación denunciada por las organizaciones sociales y de derechos humanos de Santiago y Valparaíso reunidas con la misión europea, la UE debe aplicar “la cláusula de suspensión del acuerdo en razón de incumplimiento de la cláusula de democracia.” Como ocurre en los tratados con todos los puntos que no tienen que ver directamente con el comercio, el capítulo de derechos humanos no es vinculante para los Estados, como sí son los capítulos sobre propiedad intelectual o resolución de controversias, entre otros. Sin embargo la UE tiene ahora la posibilidad de actuar en consonancia con sus principios y su propia legislación de Derechos Humanos.
A su vez, el 30 de octubre la vocera de la Comunidad Europea para Asuntos internacionales y Negociaciones, Maja Kocijancic declaró sobre el caso chileno: “Deploramos la pérdida de vidas y rechazamos cualquier tipo de violencia. Debe investigarse debidamente toda violación de los derechos humanos, que deben respetarse en todas las circunstancias.”
El 22 de enero de 2020 expusieron en la Subcomisión de DDHH de la UE sobre la situación en Chile, el académico Claudio Nash, director de la cátedra de Derechos Humanos de la Universidad de Chile y Patricia Parga, por el comité de DDHH 18.10 de la red “Chile Despertó Internacional”, creada por chilenos expatriados. Nash sostuvo en su intervención que “ las violaciones descritas configuran un cuadro de graves, masivas y sistemáticas violaciones de derechos humanos. …Además, el Gobierno se ha empeñado en una agenda legislativa que busca criminalizar la protesta ciudadana y el Parlamento chileno no ha sido capaz de controlar y limitar dicha criminalización.” Patricia Parga por su parte recordó que Chile fue el primer país de América Latina que firmó un acuerdo de libre comercio con la Unión Europea, pero agregó “¿Qué sentido tiene incluir una cláusula sobre ddhh, creada especialmente para ser aplicada en contextos como el señalado… que no obliga a las partes a respetarla?” Concluyó llamando a las instituciones europeas a dejar su silencio cómplice y condenar las graves, masivas y sistemáticas violaciones a los derechos humanos cometidas por el Estado chileno.
Modelo al desnudo
El estallido social detonado el 18 de octubre evidenció la enorme desigualdad existente a nivel social pero también desnudó el modelo económico neoliberal, sostenido por el extractivismo y los tratados de libre comercio. Al calor de la revuelta, ambos factores han sido reconocidos como determinantes en el deterioro ambiental y la vulneración de derechos básicos a la educación, la previsión, la salud, entre otros. Ya en 2018 alertábamos que Chile no puede seguir teniendo relaciones de tipo colonial con la UE, y llamábamos la atención sobre los impactos negativos que preveíamos respecto de la continuidad del Tratado de Asociación con la UE. El nuevo texto ahora con acento en la energía y la propiedad intelectual, acentúa el rol proveedor de Chile de materias primas como cobre, litio (en que Chile es el principal proveedor para la industria automotriz europea), frutas, salmón, semillas, profundizando así el saqueo de los bienes comunes, la depredación de territorios y el despojo de comunidades en el área minera. En materia de resolución de controversias, los riesgos son similares a los que presenta el TPP11 ya que las medidas adoptadas para elevar estándares ambientales, por ejemplo, o que tengan que ver con condicionar la inversión a entrega de tecnología, pueden ser consideradas como obstáculos al comercio y llevar a Chile a ser demandado en paneles internacionales que no cumplen con las reglas del debido proceso. En cuanto a género, un tema de carácter no vinculante presente en los nuevos TLC y en el nuevo tratado UE-Chile, una economía basada en la exportación de monocultivos alimentarios y forestales (celulosa), sólo traería más impactos negativos en las mujeres temporeras, afectadas por cánceres (por uso de agrotóxicos) y en su salud reproductiva (niños con malformaciones), y por otra parte la multiplicación de centrales hidroeléctricas de paso o de salmonicultura seguiría contribuyendo a dejar a las comunidades campesinas e indígenas sin agua para las huertas de autosubsistencia de las mujeres campesinas e indígenas y su provisión de yerbas medicinales. Plaguicidas altamente peligrosos, como el herbicida Paraquat, prohibido en Europa, ya se usan ampliamente en cultivos de exportación incluidos los de avellanos europeos, base para la elaboración de la nutella del desayuno europeo. Estas graves vulneraciones al derecho humano a la salud integral, y al derecho a la alimentación, se suman potencialmente a las violaciones a los derechos humanos en el curso de la revuelta popular.
Un informe de la DIRECON del 2015 indicaba que mientras las exportaciones a la UE crecían anualmente en 11%, las importaciones de maquinaria y productos industriales, aumentaban un 13% anual. En 2015, la balanza comercial ya arrojó 800 millones de dólares de déficit para Chile. Estas objeciones sin duda no son consideradas válidas por el gobierno chileno, que continúa apegado a un fracasado concepto de desarrollo.
En numerosos documentos, incluidos aquellos con los que inició la renegociación del Acuerdo de Libre Comercio con Chile, la Unión Europea se presenta ante la sociedad civil con una sólida adscripción a los derechos humanos. Los principios, sin embargo, deben ser coherentes con la práctica. Por ello, con la autoridad que nos confiere un pueblo consciente de sus derechos y con el dolor de nuestros caídos y caídas en la revuelta popular, demandamos a la Comisión Europea, órgano ejecutivo de la UE, en su misión de defensa de los tratados de la Unión, y al Consejo de la UE, que instruyan el cese inmediato de la renegociación del Acuerdo de Asociación entre la Unión Europea y Chile, cumpliendo así con la legislación de DDHH de la UE, la Declaración de DDHH de la UE y el Tratado de Lisboa, y aplicando el mismo estándar para su socio comercial. El Parlamento Europeo está llamado a controlar que la Comisión Europea lo haga. Asimismo, llamamos a los chilenos y chilenas del Comité 18.10 a apoyar esta demanda para aislar al gobierno del Presidente Piñera, que escogió el camino de la criminal represión a su pueblo y pretende seguir imponiendo nuevas leyes y tratados como si contara con respaldo ciudadano.
